State Legislation Requiring City Approval
Purpose
When the State Legislature passes a law affecting the City, the City must vote on whether to certify this law.
Process
Secretary of State: Sends the bill and certificate of approval of special law to the Intergovernmental Relations (IGR) staff.
IGR staff: Prepares a request for council action with resolution for the Intergovernmental Relations (IGR) committee.
Council Committee Coordinator: Places the bill on the IGR committee agenda. After IGR committee approval, the Committee Coordinator prepares the Council action and petitions the bill.
City Clerk staff: After the City Council approves the state law and it is published in Finance and Commerce, the clerk’s staff prepares a letter from the City Clerk. The clerk attaches a copy of the resolution from Finance and Commerce, with the certificate of approval. The seal is stamped on the certificate. Duplicate copies of the letter and the certificate of approval are sent to the Secretary of State. The Secretary of State returns a copy of the certificate with their file date stamped on it.
Deadlines: State laws must be certified before the next Legislative session.
