CDRS Committee Report of May 2, 2017

1.    2017 Consolidated Plan Action Plan (17-00598)

1.    Directing staff to summarize public comments received through the 30-day public comment period of April 6, 2017 through May 5, 2017, in the 2017 Consolidated Plan Action Plan.

2.    Approving the 2017 Consolidated Plan Action Plan.

3.    Authorizing submittal of the City of Minneapolis 2017 Consolidated Plan Action Plan to the U.S. Department of Housing and Urban Development (HUD) after the City has been notified of the 2017 HUD Community Development Block Grant (CDBG), Home Investment Partnerships (HOME), Emergency Shelter Grant (ESG), and Housing Opportunity for Persons with AIDS (HOPWA) entitlement program allocation but no later than Aug. 16, 2017.

4.    Directing Finance staff to apply proportional project/program allocation adjustments to the prior approved 2017 General Budget Resolution project/program allocations after HUD notification of entitlement award amount.

5.    Directing Finance staff to incur any necessary pre-award costs for programming consistent with 2017 Consolidated Plan Action Plan.

2.    Modification No. 3 to the Consolidated Redevelopment Tax Increment Financing (TIF) Plan (17-00599)

Passage of Resolution approving Modification No. 3 to the Consolidated Redevelopment Tax Increment Financing (TIF) Plan, which updates the projected amount of tax increment that will be generated and distributed to the City over the life of the Consolidated Redevelopment TIF District.

        Action Taken: Adopted.

3.    Penny’s Coffee, LLC, doing business as Penny’s Coffee, 100 Washington Ave S (17-00600)

1.    Approving application of Penny’s Coffee, LLC, doing business as Penny’s Coffee, for an On Sale Liquor with Sunday Sales, Class D License (expansion of premises).

2.    Rescinding the Business License Operating Conditions Agreement related to the On Sale Wine with Strong Beer License held by Penny's Coffee, adopted on February 13, 2017, set forth in File No. 17-00144.

        Action Taken: Adopted.

4.    Sunday liquor sales ordinance (17-00416)

Passage of Ordinance amending Title 14, Chapter 364 of the Minneapolis Code of Ordinances relating to Liquor and Beer: Liquor Regulations, amending provisions related to Sunday sales for off-sale liquor licenses.

        Action Taken: Adopted.

5.    Liquor, Business, and Gambling Licenses Applications (17-00601)

Approving Liquor, Business, and Gambling Licenses as recommended in the Licenses & Consumer Services Agenda for May 2, 2017, subject to final inspection and compliance with all provisions of applicable codes and ordinances.

6.    Business License Operating Conditions for Sharbel Petroleum Co., doing business as Tesoro Riverside Shop: 2517 Riverside Ave (17-00602)

Adopting the Business License Operating Conditions Agreement negotiated between the City of Minneapolis and Sharbel Petroleum Co., doing business as Tesoro Riverside Shop, allowing the licensee to obtain the Extended Hours License at 2517 Riverside Ave, subject to adherence with the conditions contained therein.

        Action Taken: Adopted.

7.    Portland Village loan amendment:  1829 Portland Ave S (17-00603)

Authorizing an amendment to an existing HOME loan to Portland Village, LP, for Portland Village at 1829 Portland Ave, which reduces the loan interest rate from 6.09% to 0.0% for all interest accruing in the future.

        Action Taken: Adopted.

8.    East Town Apartments Limited Partnership bond issuance:  East Town Apartments, 815 S 6th St (17-00604)

Passage of Resolution granting approval for Hennepin County Housing and Redevelopment Authority to undertake a housing project on behalf of East Town Apartments Limited Partnership, for a project at 815 S 6th St, through the issuance of up to $20,000,000 of Multifamily Housing Revenue Bonds.

        Action Taken: Adopted.

9.    Contract amendments with Minnesota Homeownership Center (17-00605)

Authorizing amendments to contracts with Minnesota Homeownership Center totaling $275,000 as follows:

1.    Increasing Contract C-41504 for administration and oversight of homeownership education curriculum, along with foreclosure prevention and detailed financial counseling services by $95,000, and extending through Sept. 30, 2018.  This will include collection and analysis of counseling data.

2.    Increasing Contract C-41480 to cover payments to counseling agencies for foreclosure prevention counseling by $80,000, and extending through Sept. 30, 2018.

3.    Increasing Contract C-41479 for the financial and homeownership counseling services by a network of counseling agencies, as well as collection and analysis of the counseling data, by $100,000, and extending through Sept. 30, 2018.

        Action Taken: Adopted.

10.  Agreement with Minnesota Housing (MHFA) to receive and use the Predictive Cost Model (17-00606)

Authorizing an agreement with Minnesota Housing (MHFA) to receive and use the Predictive Cost Model to assist with assessing cost containment for affordable housing projects and authorizing the CPED Director to approve extending such agreement to subsequent versions of the Predictive Cost Model that are developed by MHFA.

        Action Taken: Adopted.

11.  Hazardous property at 4108 Beard Ave S, owners Daniel Fobbe & Diane Mach (17-00608)

Approving waiver of the 60-day waiting period set forth in Chapter 249 of the Minneapolis Code of Ordinances for the property at 4108 Beard Ave S, owned by Daniel Fobbe and Diane Mach, having concurred with the Director of Regulatory Services that said property constitutes an immediate hazard to public health and safety, pursuant to section 249.30, and that the other procedures as set out in Chapter 249 may be implemented immediately.

        Action Taken: Adopted.

 

Health, Environment & Community Engagement

HECE Committee Report of May 1, 2017

1.    Grant from New Venture Fund for Healthy Babies Bright Futures Program (17-00575)

1.    Accepting a grant from the New Venture Fund in the amount of $30,000 for their Healthy Babies Bright Futures Project to reduce neurotoxic chemicals in Minneapolis.  (9 votes)

2.    Authorizing an agreement with New Venture Fund for the grant.

3.    Passage of Resolution appropriating the funds to the Health Department.

Action Taken: Adopted.

2.    Contract amendment with Balvina Jones for lead remediation services (17-00576)

Authorizing an increase to Contract No. C-39730 with Balvina Jones in the amount of $50,000, for a revised contract total of $100,000, and to extend the contract through Dec. 31, 2018, for maintenance of the City’s lead safe house.

        Action Taken: Adopted.

3.    Data Use Agreement for Healthy Start Program (17-00577)

Authorizing an agreement between the City of Minneapolis through its Health Department, the Minnesota Department of Health through its Office of Vital Records, and the federal Health Resources and Services Administration through its Maternal and Child Health Bureau, to link Healthy Start Program participant data to vital records data and share vital records data of mothers who gave birth in Hennepin County.

        Action Taken: Adopted.

 

Transportation & Public Works

TPW Committee Report of May 2, 2017

1.    8th St SE (Central Ave NE to 15th Ave SE) Street Resurfacing: Project approval and assessment (17-00583)

1.    Passage of Resolution ordering the work to proceed and adopting special assessments in the amount of $270,412.93 for the 8th St SE (Central Ave NE to 15th Ave SE) Street Resurfacing Project, Special Improvement of Existing Street No. 9964G (CPV1756).

2.    Passage of Resolution requesting the Board of Estimate and Taxation authorize the City’s issuance and sale of assessment bonds in the amount of $270,415 for the project.  (9 votes)

        Action Taken: Adopted.

2.    South Hay Area Residential Street Resurfacing: Project approval and assessment (17-00584)

1.    Passage of Resolution ordering the work to proceed and adopting special assessments in the amount of $892,207.25 for the South Hay Area Residential Street Resurfacing Project, Special Improvement of Existing Street No. 9964F (CPV1756).

2.    Passage of Resolution requesting the Board of Estimate and Taxation authorize the City’s issuance and sale of assessment bonds in the amount of $892,210 for the project.  (9 votes)

        Action Taken: Adopted.

3.    Limited time parking ordinance (17-00374)

Passage of Ordinance amending Title 18 of the Minneapolis Code of Ordinances relating to Traffic Code, repealing the definition and amending provisions related to limited time parking:

1.    Chapter 466 In General.

2.    Chapter 478 Parking, Stopping and Standing.

        Action Taken: Adopted.

4.    Special Service Districts: 2017 operating plan and budget amendments (17-00585)

Authorizing amendments to the 2017 operating plans and budgets for the 50th and France, 54th & Lyndale, Bloomington-Lake, Central Avenue, 48th Street East and Chicago Avenue South, Chicago-Lake, East Lake, Eat Street, Linden Hills, Lowry Hill, Lyndale Lake, Stadium Village, Uptown, and West Broadway Improvement Special Service Districts to incorporate 2016 year-end budget surpluses.

        Action Taken: Adopted.

5.    Emerson Ave N and Fremont Ave N Pedestrian and Bikeway Improvements Project: Layout (17-00586)

Approving the layout for the Pedestrian and Bikeway Improvements Project along Emerson Ave N (from Plymouth Ave N to 33rd Ave N) and Fremont Ave N (from Plymouth Ave N to 44th Ave N) (CPV115).

        Action Taken: Adopted.

6.    Lyndale School Crossings Project: Safe Routes to School grant agreement terms and conditions and maintenance commitment (17-00587)

1.    Passage of Resolution agreeing to grant agreement terms and conditions for Safe Routes to School funds for the Lyndale School Crossings Project.

2.    Passage of Resolution agreeing to maintain facility for the Safe Routes to School Program in conjunction with the Lyndale School Crossings Project.

Early signature by Mayor requested.

7.    42nd Ave N Street Reconstruction Project: Special assessment reduction for 3800 Penn Ave N (17-00588)

1.    Passage of Resolution amending Resolution 2017R-096 entitled “Ordering the work to proceed and adopting special assessments for the 42nd Ave N (Municipal State Aid Street 262) Street Reconstruction Project, Special Improvement of Existing Street No. 6756,” passed Feb. 24, 2017, due to a reduction of the assessment for the property located at 3800 Penn Ave N (CPV096).

2.    Passage of Resolution amending Resolution 2017R-097 entitled “Requesting the Board of Estimate and Taxation to issue and sell City of Minneapolis bonds in the amount of $1,771,220 for certain purposes other than the purchase of public utilities,” passed Feb. 24, 2017, to reduce the bonds requested to be sold for the 42nd Ave N Street Reconstruction Project due to a reduction of the assessment for the property located at 3800 Penn Ave N.  (9 votes)

        Action Taken: Adopted.

8.    I-35W and Lake Street Transit Access Project: Supplemental Agreement to Cooperative Agreement with Minnesota Department of Transportation related to sanitary sewer design (17-00589)

Passage of Resolution authorizing execution of Supplemental Agreement No. 1 to Cooperative Agreement No. C-41096 with the Minnesota Department of Transportation authorizing the City of Minneapolis to perform engineering services related to sanitary sewer design and the bidding phase for the I-35W and Lake Street Transit Access Project, Chapter 152 Bridges Project, and I-35W Rehabilitation Project S.P. 2782-327 (TH 35W) (CPV1674TAP).

Action Taken: Adopted.

9.    I-35W and Lake Street Transit Access Project: Supplemental Agreement to Cooperative Agreement with Minnesota Department of Transportation related to watermain design (17-00590)

Passage of Resolution authorizing execution of Supplemental Agreement No. 2 to Cooperative Agreement No. C-41095 with the Minnesota Department of Transportation authorizing the City of Minneapolis to perform engineering services related to watermain design and the bidding phase for the I-35W and Lake Street Transit Access Project, Chapter 152 Bridges Project, and I-35W Rehabilitation Project S.P. 2782-327 (TH 35W) (CPV1674TAP).

        Action Taken: Adopted.

10.  Biennial Routine Maintenance Agreement between the City of Minneapolis and the Minnesota Department of Transportation (17-00591)

Passage of Resolution authorizing execution of the biennial Routine Maintenance Agreement between the State of Minnesota, Department of Transportation and the City of Minneapolis effective July 1, 2017, through June 30, 2019.

        Action Taken: Adopted.

11.  Federal Highway Safety Improvement Program funding (17-00592)

1.    Accepting additional Federal Highway Safety Improvement grant funds in the amount of $931,879, for a total amount of $5,790,105, for intersection and traffic signal improvements, pursuant to Minnesota Department of Transportation Agency Agreement No. 99903.  (9 votes)

2.    Passage of Resolution increasing the appropriation for the Public Works Department by $931,879 in Safety Program CTR022 to reflect additional grant funds.

        Action Taken: Adopted.

12.  Bid for 18th Ave NE Street Construction Project (17-00594)

Accepting low bid of Park Construction Company, submitted on Official Publication No. 8396 for an estimated total expenditure of $2,688,751.82, to provide all materials, labor, equipment, and incidentals for the 18th Ave NE Street Construction Project (S.A.P. 141-284-005) (CPV080), and authorizing a contract for the project, all in accordance with City specifications.

        Action Taken: Adopted.

13.  Bid for Nicollet Island Pump Station Construction Project (17-00595)

Accepting low bid of Magney Construction, Inc., submitted on Official Publication No. 8415 in the amount of $839,645, to provide all labor, materials, equipment, and incidentals for the construction of the Nicollet Island Pump Station, and authorizing a contract for the project, all in accordance with City specifications.

        Action Taken: Adopted.

14.  Bid for cleaning of large diameter sanitary sewer system (17-00596)

Accepting low bid of Diversified Infrastructure Services, Inc., submitted on Official Publication No. 8422 for an estimated total expenditure of $349,169, to provide all materials, labor, equipment, and incidentals for the cleaning of the large diameter sanitary sewer system, and authorizing a contract for the service, all in accordance with City specifications.

15.  2017 Drinking Water Week (17-00597)

Passage of Resolution declaring May 7 - 13, 2017, as Drinking Water Week.

WM Committee Report of May 8, 2017

1.    Legal settlement – Abdalla Kahiye v. City of Minneapolis and Steven Setzer (17-00611)

Approving the settlement of the lawsuit brought by Abdalla Kahiye, Hennepin County District Court File No. 27-CV-15-1837, by payment of $10,000 to McEllistrem Fargione, P.A., and authorizing the City Attorney’s Office to execute any documents necessary to effectuate the settlement.

        Action Taken: Adopted.

2.    Legal settlement – claim of Andrea J. Piper (17-00612)

Approving the settlement of the Workers’ Compensation claim of Andrea J. Piper by payment of $180,000 to Andrea J. Piper and her attorneys, Margolis Law Firm, and authorizing the City Attorney’s Office to execute any documents necessary to effectuate the settlement.

        Action Taken: Adopted.

3.    Legal settlement – claim of Deandre McCoy June (17-00613)

Approving the settlement of the personal injury claim of Deandre McCoy June by payment of $4,750 to Deandre McCoy June and her attorneys, Lewis & Associates, and authorizing the City Attorney’s Office to execute any documents necessary to effectuate the settlement.

        Action Taken: Adopted.

4.    Legal settlement – Vicki Jung v. City of Minneapolis (17-00614)

Approving the settlement of the lawsuit brought in the matter of Vicki Jung v. City of Minneapolis, Hennepin County District Court, Court File No. 27-CV-16-13367, by the payment of $45,000 to Vicki Jung and her attorneys at Baillon Thome Jozwiak & Wanta LLP, and authorizing the City Attorney’s Office to execute any documents necessary to effectuate the settlement.

        Action Taken: Adopted.

5.    Legal settlement – claim of Jerome A. Steffens (deceased) by Sandra Steffens (17-00615)

Approving the settlement of the Workers’ Compensation claim of Jerome A. Steffens (deceased) by Sandra Steffens by payment of $111,040.74, to be disbursed in the amount of $63,781.18 to Sandra Steffens and her attorney, Steven D. Hawn, and $47,259.56 to Medica Health Plans, and authorizing the City Attorney’s Office to execute any documents necessary to effectuate the settlement.

        Action Taken: Adopted.

6.    Contract with Go Beyond, LLC, to enable Minneapolis Healthy Start to remain compliant with federal program requirements (17-00617)

Authorizing a contract with Go Beyond, LLC, using the vendor’s form for two and one-half years for the access of their various reports for Minneapolis Healthy Start to remain compliant with federal program requirements, for a not-to-exceed amount of $20,000.

        Action Taken: Adopted.

7.    Gift acceptance of conference participation and related travel expenses for participation in SharePoint Fest DC technology conferences (17-00618)

Passage of Resolution accepting gifts covering conference and travel expenses for Tamara Bredemus, Minneapolis Director of Collaborative Services, to participate as a speaker in the SharePoint Fest DC technology conference from April 16-21, 2017. (9 votes)

8.    Contract with Hennepin Technical College for a summer skills class (17-00619)

Authorizing a contract with Hennepin Technical College (HTC) for a summer 2017 skills training class at a cost of $24,000 for training conducted between June 5 and July 27, 2017, using the contract prepared by HTC.

9.    Grant from the Minnesota Department of Commerce for Minnesota Auto Theft Prevention Program (17-00620)

Authorizing a contract with the Minnesota Department of Commerce to accept $392,462 for the Police Auto Theft Prevention Program for two years, from July 1, 2017-June 30, 2019. (9 votes)

        Action Taken: Adopted.

1.    Wellington Condominium Housing Improvement Area ordinance (17-00578)

Pursuant to notice, motion by Goodman to introduce the subject matter of an ordinance amending Title 16, Chapter 421 of the Minneapolis Code of Ordinances relating to Planning and Development: Housing Improvement Areas, for first reading and referral to the Community Development & Regulatory Services Committee, for a public hearing on May 16, 2017, adding a new Article II entitled "Wellington Condominium Housing Improvement Area" to establish the area and impose fees to pay for housing improvements within the area.

 

Action Taken: Introduced, given its first reading, and referred to the Community Development & Regulatory Services Committee.

 

2.    Regulation of Telecom Antennas ordinance (17-00579)

Pursuant to notice, motion by B. Johnson to the subject matter of an ordinance amending Title 20, Chapter 535 of the Minneapolis Code of Ordinances relating to Zoning Code:  Regulations of General Applicability, for first reading and referral to the Zoning and Planning Committee, amending provisions related to telecom antennas in the Right of Way and general housekeeping of Article VIII Communications Towers, Antennas, and Base Units.

 

Action Taken: Introduced, given its first reading, and referred to the Zoning & Planning Committee.
