Staff report

A. Street Renaming: Application by Council Member Warsame for commemorative street names to be assigned to three street segments in the Cedar Riverside neighborhood, as follows:

These street names are commemorative only and existing addresses will not change

Recommended Motion: The Department of Public Works and the Department of Community Planning and Economic Development recommend that the City Planning Commission and City Council adopt the findings and approve the petition to add commemorative names to three segments of right-of-way, including:

2. 312 W 59th St (BZZ-6964 and MS-234, Ward: 11) (Kimberly Holien).

Staff report

A. Minor Subdivision: Application by Sarah Whiting of Lindquist and Vennum, LLP, on behalf of Jacqueline Cannon, for a minor subdivision to subdivide the property at 312 W 59th St, into two parcels.  The property is zoned R1A, Single-family Residence district and AP, Airport Overlay district.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the minor subdivision application for the property located at 312 W 59th St.

B. Variance: Application by Sarah Whiting of Lindquist and Vennum, LLP, on behalf of Jacqueline Cannon, for a variance to reduce the front yard setback of the existing single family home from 20 feet to 19.7 feet for the property located at 312 W 59th St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the variance application to reduce the required front yard setback from 20 feet to 19.7 feet for the property located at 312 W 59th St. 

3. Hiawatha College Prep - Northrop (BZZ-6945, Ward: 11) 1611 E 46th St (Mei-Ling Anderson).

Staff report

A. Conditional Use Permit: Application by U+B Architecture and Design, Inc., on behalf of Charter Schools Development Corporation, for a conditional use permit to allow a new school for students in grades 5 through 8 in the R3 Multiple-family Residential District located at 1611 E 46th St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow a new school for students in grades 5 through 8 in the R3 Multiple-Family District at the property located at 1611 E 46th St, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Variance: Application by U+B Architecture and Design, Inc., on behalf of Charter Schools Development Corporation, for a variance to increase the maximum allowed floor area ratio (FAR) for the property located at 1611 E 46th St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the maximum allowed floor area ratio from 0.5 to approximately 0.62 at the property located at 1611 E 46th St.

C. Variance: Application by U+B Architecture and Design, Inc., on behalf of Charter Schools Development Corporation, for a variance to allow a parking area to be located between a principal structure in a residence district and the front lot line adjacent to 16th Ave S for the property located at 1611 E 46th St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to allow a parking area to be located between a principal structure in a residence district and the front lot line adjacent to 16th Ave S at the property located at 1611 E 46th St.

D. Site Plan Review: Application by U+B Architecture and Design, Inc., on behalf of Charter Schools Development Corporation, for a site plan review for the property located at 1611 E 46th St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow a new, 45,429 square foot building at the property located at 1611 E 46th St, subject to the following conditions:

  1. Approval of the final site plan, landscaping plan, and elevations, by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by January 12, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. All signs shall comply with Chapter 543 of the zoning code. All signage requires a separate permit from CPED.
  4. The applicant shall increase the window area on the first floor of the south elevation facing 47th St E to comply with the minimum requirements of section 530.120 of the zoning code.
  5. The landscaping plan shall be consolidated into a single plan and plant schedule, and indicating that all areas of the property not covered by buildings, parking areas, or loading shall contain landscaping materials.
  6. The landscaping plan shall demonstrate compliance with the minimum screening and linear tree requirements along the parking frontage areas on both 47th St E and 16th Ave S.
  7. The landscaping and screening materials should be extended to cover the northwest corner of the proposed parking area.
  8. The proposed walkway along the north side of the new surface parking lot shall be located adjacent to the parking area and shall extend along the entire length of the parking lot from east to west.
  9. The applicant shall work with staff to explore the relocation of the parking area access from 16th Ave S to 47th St E.

4. New Horizon Academy (BZZ-6946, Ward: 4) 3354 Penn Ave N (Hilary Dvorak).

Staff report

A. Conditional Use Permit: Application by Peter Hilger, AIA with Rylar, LLC, on behalf of New Horizon Academy, for a conditional use permit to increase the height of a building from 2.5 stories/35 feet to 3 stories/38 feet for the property located at 3354 Penn Ave N.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to increase the height of the building from 2.5 stories/35 feet to 3 stories/38 feet at the property located at 3354 Penn Ave N, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Variance: Application by Peter Hilger, AIA with Rylar, LLC, on behalf of New Horizon Academy, for a variance to increase the maximum floor area of an individual commercial use for the property located at 3354 Penn Ave N.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the maximum floor area of an individual commercial use from 8,000 square feet to 13,497 square feet at the property located at 3354 Penn Ave N.

C. Variance: Application by Peter Hilger, AIA with Rylar, LLC, on behalf of New Horizon Academy, for a variance to reduce the minimum off-street parking requirement for the property located at 3354 Penn Ave N.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance of the minimum off-street parking requirement from 29 spaces to 14 spaces at the property located at 3354 Penn Ave N, subject to the following condition:

  1. Two of the parking spaces shall be signed for short-term drop off only.

D. Variance: Application by Peter Hilger, AIA with Rylar, LLC, on behalf of New Horizon Academy, for a variance to reduce the minimum width of a two-way drive for the property located at 3354 Penn Ave N.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the minimum width of a two-way drive aisle from 22 feet to 20 feet at the property located at 3354 Penn Ave N.

E. Variance: Application by Peter Hilger, AIA with Rylar, LLC, on behalf of New Horizon Academy, for a variance to increase the height of two wall signs for the property located at 3354 Penn Ave N.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the height of two wall signs from the permitted 14 feet to 31.5 feet at the property located at 3354 Penn Ave N.

F. Site Plan Review: Application by Peter Hilger, AIA with Rylar, LLC, on behalf of New Horizon Academy, for a site plan review for the property located at 3354 Penn Ave N.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow a new 3-story, 13,497 square foot commercial building at the property located at 3354 Penn Ave N, subject to the following conditions:

  1. Approval of the final site plan, landscaping plan, elevations and lighting plan by the Department of Community Planning and Economic Development
  2. All site improvements shall be completed by January 12, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. There shall be no blank walls over 25 feet in length as required by section 530.120 of the zoning code.
  4. Landscape materials that provide the required screening per section 530.170 of the zoning code shall be planted in the landscaped yards along both Penn Ave N and 34th Ave N.
  5. The fence located along the south property line cannot exceed four feet in height where it is adjacent to the house.
  6. A combination of fencing and landscape materials that provide the required screening per section 530.170 of the zoning code shall be planted in the northern one-third of the east landscaped yard and the southern landscaped yard.
  7. The film on the 1st floor windows on the south side of the building shall be removed so the minimum window requirement can be met.

5. AC Hotel Minneapolis (BZZ-6956, Ward: 3) 401 Hennepin Ave (Kimberly Holien).

Staff report

A. Conditional Use Permit: Application by Dan Lessor of Mortenson Development for a conditional use permit to allow seven surface parking stalls for the property located at 401 Hennepin Ave, in the B4-2 Downtown Business district and the DP, Downtown Parking Overlay district.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow eight surface parking stalls in the DP, Downtown Parking Overlay district for the property at 401 Hennepin Ave, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Conditional Use Permit: Application by Dan Lessor of Mortenson Development for a conditional use permit to allow two wall signs at the top of the building, notwithstanding the height and area limits for signs in the Downtown Districts for the property located at 401 Hennepin Ave.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow two wall signs at the top of the building, notwithstanding the height and area limits for signs in the Downtown Districts, for the property located at 401 Hennepin Ave, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C. Variance: Application by Dan Lessor of Mortenson Development for a variance to allow wall signs to be placed on non-primary building walls and to increase the area of said wall signs for the property located at 401 Hennepin Ave.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to allow wall signs to be placed on non-primary building walls and to increase the height and area of said wall signs for the property located at 401 Hennepin Ave.   

D. Site Plan Review: Application by Dan Lessor of Mortenson Development for a site plan review for the property located at 401 Hennepin Ave.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission approve the site plan review application for a nine-story hotel with 244 rooms on the property at 401 Hennepin Ave, subject to the following conditions:

  1. All site improvements shall be completed by January 12, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  2. CPED Staff shall review and approve the final site, elevation, landscaping and lighting plans before building permits may be issued.
  3. No shelving, signage, merchandise, newspaper racks or other similar fixtures shall be placed in front of the required ground level transparent windows.
  4. All required ground floor windows shall have clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher, in compliance with 530.120 of the zoning code.
