1.   Land Sale – 1418 Sheridan Ave N (Staff: Jim Voll)

Review for consistency with the Comprehensive Plan the sale of 1418 Sheridan Ave N for the rehabilitation of a single-family home.

Recommended Motion: Approve the staff report - the item consistent with the Minneapolis Plan.

2.   Land Sale – Green Homes North Round 4: 2915 - 4th St N, 2945 Bryant Ave N, 3607 Bryant Ave N, 2627 Dupont Ave N, 3519 Dupont Ave N, 3539 Fremont Ave N, 2719 Irving Ave N, 2517 James Ave N, 2958 Knox Ave N, 3011 Knox Ave N, 3100 Newton Ave N, 2027 Russell Ave N, and 3115 Sheridan Ave N (Staff: Jim Voll)

Recommended Motion: Approve the staff report - the item consistent with the Minneapolis Plan.

3.   Appointments to the Board of Adjustment (Staff: Janelle Widmeier)

Consider the following appointment to the Board of Adjustment: Anja Dresher – term to expire December 31, 2017; Consider the following reappointments to the Board of Adjustment: Matt Perry and Jacob Saufley – terms to expire December 31, 2017.

Recommended Action: Approve the appointments to the Board of Adjustment.

Introduction to the Public Hearing

1. Mill City Quarter (PL-287, Ward: 3) 300 2nd St S, 101 3rd Ave S and 428 2nd St S (Janelle Widmeier).

Staff report

A. Plat: Application by Lupe Development and Mill Place Inc. for a preliminary plat to replat the properties of 300 2nd St S, 101 3rd Ave S, and 428 2nd St S.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the preliminary plat application for the properties located at 300 2nd St S, 101 3rd Ave S and 428 2nd St S.

2.  Street Vacations (Vac-1619 and Vac-1622, Ward: 3) (Hilary Dvorak).

Staff report

A. Vacation: Application by Steve Maki with the Minnesota Sports Facilities Authority to vacate portions of 4th St S and 5th St S as they relate to the construction of the new stadium located at 401 Chicago Ave. Vacation (Vac 1619) 5th St S, lying northwesterly of 6th St S and lying between Chicago Ave and 11th Ave S.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and the City Council approve the application to vacate 5th St S lying northeasterly of 6th St S and lying between Chicago Ave and 11th Ave S subject to the retention of easements by CenterPoint Energy, MCI Communications Services Inc., Comcast, County of Hennepin, Xcel Energy and CenturyLink.

B. Vacation: Application by Steve Maki with the Minnesota Sports Facilities Authority to vacate portions of 4th St S and 5th St S as they relate to the construction of the new stadium located at 401 Chicago Ave. Vacation (Vac 1622) Parts of 4th St S, adjoining the east side of the Metrodome parcel.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council approve the application to vacate parts of 4th St S adjoining the East side of the Metrodome parcel subject to the retention of easements by MCI Communications Services Inc.

3. Fiant Dental sign (BZZ-6975, Ward: 8) 3225 Lyndale Ave S (Mei-Ling Anderson).

Staff report

A. Nonconforming Use Expansion: Application by Jamie Graham, on behalf of Allegro Properties, for an expansion of a non-conforming use to allow a 16 square-foot illuminated sign on the property at 3225 Lyndale Ave S in the R4 Multiple-family district.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for an expansion of a nonconforming use to allow a 16 square-foot illuminated sign on the west elevation on the building located at 3225 Lyndale Ave S in the R4 Multiple-family district.

4. Boone Trucking U-Haul (BZZ-6955, Ward: 3) 1516 Marshall St NE (Lisa Steiner).

Staff report

A. Conditional Use Permit: Application by Sharon Persaud, on behalf of Boone Trucking Inc, for a conditional use permit for a truck rental business for the property located at 1516 Marshall St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to allow truck rental at the property located at 1516 Marshall St NE, subject to the following conditions:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 within sixty (60) days of Planning Commission approval.
  2. No cars or trucks shall utilize the public right-of-way for maneuvering purposes.
  3. No trucks with more than 15,000 pounds gross vehicle weight shall be parked within 100 feet of the adjacent residential district as required by Section 550.110 of the zoning code.
  4. The barbed wire atop the existing fence shall be removed where within 100 feet of the residential district boundary as required by Section 535.430 of the zoning code.
  5. The property owner shall discontinue any storage on the public right-of-way, remove the fence which encroaches onto the public right-of-way of Water St NE, and install a fence along their property line as shown in the submitted survey.
  6. Any portions of fencing in poor condition shall be repaired as required in Section 535.410 of the zoning code.
  7. The entire site not covered by buildings or landscaping shall be surfaced with a dustless all-weather hard surface material capable of carrying a wheel load of four thousand (4,000) pounds as required by Section 541.300 of the zoning code. Acceptable surfacing materials shall include asphalt, concrete, brick, cement pavers or similar material installed and maintained per industry standards.
  8. All site improvements shall be completed by July 26, 2016, unless extended by the zoning administrator, or the permit may be revoked for non-compliance.

B. Site Plan Review: Application by Sharon Persaud, on behalf of Boone Trucking Inc, for a site plan review for a transportation use for the property located at 1516 Marshall St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application to allow the proposed transportation use at the property located at 1516 Marshall St NE, subject to the following conditions:

  1. Approval of the final site and landscaping plans by CPED.
  2. All site improvements shall be completed by July 26, 2016, unless extended by the zoning administrator, or the permit may be revoked for non-compliance.
  3. Installation and maintenance of all landscape materials shall comply with Section 530.210 of the zoning code.
  4. Any new signs are required to meet the requirements of Chapter 543 of the zoning code and a separate permit must be obtained from CPED.
  5. All lighting shall meet the standards in Section 535.590 of the zoning code.
  6. For the existing waste hauling business, no waste shall be stored or maintained on-site, as required by Section 536.20 of the zoning code.
  7. At least 67 shrubs shall be located on the site as required by Section 530.160 of the zoning code.
  8. As required by Section 530.170 of the zoning code, a 7 foot landscaped yard, with screening at least 3 feet high and 60% opaque and two trees, is required to provide screening of the parking area along Marshall Street NE. Along the west and southernmost property lines which abut unimproved public streets, a 7 foot landscaped yard with screening at least 3 feet high and 60% opaque and one tree per 25 feet of linear frontage is required. Additionally, the northwest corner of the parking area left unavailable for parking or vehicular circulation shall be landscaped.
  9. The approximately 1,500 square foot gravel portion of the site in the northeast section of the site near Marshall Street NE shall be landscaped between the fence and the public sidewalk.

5. Bonicelli (BZZ-6963, Ward: 1) 1901 Fillmore St NE (Hilary Dvorak).

Staff report

A. Rezoning: Application by Laura Bonicelli for a rezoning from the R2B zoning district to the C1 zoning district for the property located at 1901 Fillmore St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission and City Council adopt the findings and approve the rezoning petition for the property located at 1901 Fillmore St NE from the R2B zoning district to the C1 zoning district.

B. Variance: Application by Laura Bonicelli for a variance of the enclosed building standards to allow outdoor grilling for the property located at 1901 Fillmore St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance of the enclosed building standards to allow outdoor grilling located at 1901 Fillmore St NE.

C. Variance: Application by Laura Bonicelli for a variance of the minimum drive aisle width for the property located at 1901 Fillmore St NE.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the minimum drive aisle width from 22 feet to 12 feet 11 inches located at 1901 Fillmore St NE, subject to the following condition:

  1. There shall be a five foot wide landscaped yard provided between the parking area and the north property line.

6. 602 Residences (BZZ-6965, Ward: 3) 602, 602 ½, and 606 N 1st St (Hilary Dvorak).

Staff report

A. Conditional Use Permit: Application by Curt Gunsbury for a conditional use permit to increase the height of the building located at 602, 602 ½ and 606 N 1st St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a conditional use permit to increase the height of the building from 6 stories/84 feet to 8 stories/94 feet located at 602, 602 ½ and 606 N 1st St, subject to the following condition:

  1. The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B. Variance: Application by Curt Gunsbury for a variance to increase the allowed FAR for the property located at 602, 602 ½ and 606 N 1st St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the allowed FAR from 4.8 to 6.38 located at 602, 602 ½ and 606 N 1st St.

C. Variance: Application by Curt Gunsbury for a variance to reduce the north interior side yard setback for the property located at 602, 602 ½ and 606 N 1st St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the north interior side yard setback from the required 15 feet to 0 feet located at 602, 602 ½ and 606 N 1st St.

D. Variance: Application by Curt Gunsbury for a variance to reduce the south interior side yard setback for the property located at 602, 602 ½ and 606 N 1st St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the south interior side yard setback from the required 15 feet to 0 feet located at 602, 602 ½ and 606 N 1st St.

E. Variance: Application by Curt Gunsbury for a variance to reduce the rear yard for the property located at 602, 602 ½ and 606 N 1st St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to reduce the rear yard setback from the required 15 feet to 4 feet located at 602, 602 ½ and 606 N 1st St.

F. Variance: Application by Curt Gunsbury for a variance to increase the maximum amount of parking spaces per dwelling unit for the property located at 602, 602 ½ and 606 N 1st St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the application for a variance to increase the maximum amount of parking spaces per dwelling unit from 1.7 to 1.83 located at 602, 602 ½ and 606 N 1st St plus an additional 16 spaces for the adjacent residential building.

G. Site Plan Review: Application by Curt Gunsbury for a site plan review for a 30 unit residential building located at 602, 602 ½ and 606 N 1st St.

Recommended Motion: The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt the findings and approve the site plan review application for a for a new 30-unit, 8-story residential building located at 602, 602 ½ and 606 N 1st St, subject to the following conditions:

  1. Approval of the final site plan, landscaping plan, elevations and lighting plan by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by January 26, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.
  3. All mechanical equipment shall be screened as required by section 535.70 of the zoning code.
