1.    Mill City Quarter, 300 2nd St S, 101 3rd Ave S and 428 2nd St S, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Lupe Development and Mill Place Inc.

A.   Final plat.

Recommended motion: Approve the final plat.

2.    Juba Graphics, 2923 Oakland Ave, Ward 6

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Medina Realty, on behalf of Juba Graphics.

A.   Change of nonconforming use application to allow for a printing and publication use in an existing building.

Recommended motion: Approve, subject to the following conditions:

1.     Any future signs will require a separate sign permit from CPED and must comply with 543.150 and 543.250 of the zoning code.

2.     No outdoor storage shall be allowed.

3.     Refuse and recycling containers shall be stored within the building.

4.     If a privacy fence currently does not exist along the southern property line (where there is off-street parking), a fence shall be built that is 95 percent opaque and in compliance with Chapter 535, Article VI, Fence regulations.

3.    420 E Hennepin Ave, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Tanek Architecture Design, on behalf of Java Companies.

A.   Site plan review.

Recommended motion: Approve subject to the following conditions:

1.     Per 530.120 (b) (2), the glass within the doors shall be clear or lightly tinted glass with a visible light transmittance ratio of 0.6 or higher. In addition, the windows shall not have shelving, mechanical equipment or other similar features that block views into and out of the building between four and seven feet above adjacent grade for the required window percentage.

2.     All lighting shall be required to meet the standards outlined in Section 535.590. The walkway connecting the building entrances on the south elevation to the parking lot shall be well lit. Any proposed light poles shall comply with 535.110.

3.     Per 530.180, all landscape areas shall be covered with turf grass, native grasses, perennial flowering plants, vines, wood mulch, shrubs or trees. In addition, the installation and maintenance of all landscape materials shall comply with the standards outlined in section 530.120.

4.     Per 551.100, fast food restaurants are prohibited at this location. In addition, sit down restaurants will be required to meet the specific development standard outlined in Chapter 536 that the premise, all adjacent streets and sidewalks within 100 feet shall be inspected regularly for purposes of removing any litter found thereon.

5.     The placement of the proposed bike parking spaces require an encroachment permit approved by Public Works.

6.     All rooftop mechanical equipment will be required to meet the standards outlined in Section 535.70

B.   Alley vacation.

Recommended motion: Approve the application to vacate the part of the alley as shown on the plat of Rearrangement of Block 11, St. Anthony Falls Addition, bounded by Lots 1, 2 and 3 and by Central Avenue. 

4.    2605 California St NE, Ward 1

Staff report by Suado Abdi, BZZ-7063 and MS-236

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Mike Kohler.

A.   Variance to reduce the required minimum lot area.

Recommended motion: Approve the variance to reduce required minimum lot area from 5,000 square feet to 4,881 square feet for the northerly parcel to allow a lot split, subject to the following condition of approval:

1.     Approval of the lot division by the Department of Community Planning and Economic Development.

B.   Variance to reduce the required minimum lot width.

Recommended motion: Approve the variance application to reduce required minimum lot width from 40 feet to 39.25 feet for the northerly parcel to allow a lot split, subject to the following condition of approval:

1.     Approval of the lot division by the Department of Community Planning and Economic Development.

 

C.   Minor subdivision that would create two lots at 2605 California St NE; one for the existing single family home and one that would allow for a new single family home.

Recommended motion: Approve the application for a minor subdivision to allow a lot split, subject to the following condition:

1.     The applicant shall provide evidence that the provisions outlined in Section 598.260 (1-5) are included in a deed restriction.

5.    800 W Broadway and 2019 Aldrich Ave N, Ward 5

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by William Anderson with Sherman Associates.

A.   Rezoning of 800 W Broadway.

Recommended motion: Approve the rezoning application for 800 West Broadway from the C3S and OR2 zoning districts with the WB West Broadway Overlay to the C3S zoning district with the WB West Broadway Overlay.

B.   Rezoning of 2019 Aldrich Ave N.

Recommended motion: Approve the rezoning application for 2019 Aldrich Ave N from the OR2 zoning district to the C3S zoning district and add the WB West Broadway Overlay.

C.   Conditional use permit for a school, grades K-12.

Recommended motion: Approve, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The bicycle racks shall not be located in the public sidewalk where they will block the pedestrian flow.

3.     A minimum of 18 bicycle parking spaces shall be provided.

4.     A different shrub species shall be selected for the landscaped yard on the north side of the driveway in order to meet the screening requirements of Chapter 530.

5.     The species of shrubs selected for the landscaped yards along the north property line and the alley shall grow to not less than six feet in height.

D.   Variance to reduce the off-street parking requirement.

Recommended motion: Return the variance application to reduce the off-street parking requirement from 61 spaces to 34 spaces.

E.    Variance to reduce the off-street loading requirement.

Recommended motion: Approve the variance application to reduce the off-street loading requirement from 2 small spaces to 0 spaces, subject to the following condition:

1.     The applicant shall work with the Public Works Department to try and establish an appropriate location for an on-street loading zone.

6.    Apartment Building, 721-729 8th St SE, Ward 3

Staff report by Aaron Hanauer, BZZ-7077

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Wells and Company Architects, on behalf of Dinkytown Rentals, LLC.

A.   Conditional use permit to allow a residential use in the IL/ Industrial Living Overlay District.

Recommended motion: Approve the conditional use permit subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.   Variance to increase the percentage of allowable compact off-street parking spaces.

Recommended motion: Approve the variance to increase the percentage of allowable compact off-street parking spaces from 25 percent to 55 percent, with the following condition:

1.     Per 541.330, the compact parking spaces shall be labeled as such.

C.   Site plan review.

Recommended motion: Approve the site plan review to allow for the construction of a four-story, 33-unit apartment building with the following conditions:

1.     As conditioned, all other areas not governed by Section 530.160 and 530.170 and not occupied by buildings, parking and loading facilities or driveways shall be covered with turf grass, plants, mulch, shrubs or trees. In addition, the installation and maintenance of all landscape materials shall comply with the standards outlined in section 530.210.

2.     An encroachment permit will be required for the open front porch.

3.     Per 535.110 and 535.590, the lights poles shall not exceed 35 feet in height and the lights shall not create a sensation of brightness that is substantially greater than ambient lighting conditions as to cause annoyance, discomfort or decreased visual performance or visibility to a person of normal sensitivities when viewed from any permitted or conditional residential use.

4.     Per the City of Minneapolis Guide to Exterior Building Walls and Materials, the proposed metal lap siding is not allowed and shall be replaced with limestone on the first floor and brick on floors two and three on the east, west and north elevations, like is done on the south elevation. 

5.     Per 530.120 (c), the pitched roof on the primary building shall be replaced with a flat roof.

6.     Per 530.170 (e), a seven-foot wide landscaped tree island shall be installed within the parking area to accommodate the on-site deciduous tree.

7.    North Loop Green PUD/T3 – Second Phase of the Planned Unit Development, 316 3rd Ave N, Ward 3.

This item was continued from the April 13, 2015 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Hines North Loop Green LLC.

A.   Conditional use permit to amend a planned unit development (BZZ-5484) to allow for Phase II - a new office building.

Recommended motion: Approve the conditional use permit to amend a planned unit development (BZZ-5484) to allow for Phase II - a new office building with ground floor commercial space, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The applicant shall continue to work with staff on the fence design, the location of the fence and the landscape plan as it pertains to the relocated dog run.

3.     The property manager will provide preferred parking in the parking garage for registered employer carpools/vanpools.

4.     The owner will provide a connection through the T3 Office Project site for bicycle access to the Cedar Lake Trail for both employees and the public.

5.     The owner will provide within the T3 Office Project secure bicycle storage in the bike room of the building for employees and patrons. A minimum of one hundred (100) bike spaces will be provided between the bike room and outdoor racks.

6.     The owner/property manager will implement a shared bicycle program for the employees of the T3 Office Project. The building will initially have six (6) bicycles docked in the parking garage which residents will be able to check out and return on an as-needed/as-available basis.

7.     All parking provided in the subterranean garage and project site of the T3 Office Project is specifically designated for employees of T3 Office Project, guests, and patrons. No general public parking will be available at the project site.

8.     As required by section 527.120 of the zoning code, the development shall comply with the standards for underground parking from Table 527-1, Amenities totaling a minimum of 5 points.

B.   Conditional use permit for a surface parking lot in the DP Downtown Parking Overlay District.

Recommended motion: Approve the conditional use permit for a surface parking lot in the DP Downtown Parking Overlay District, subject to the following condition:

1.     There shall be no more than 20 parking spaces located in the surface parking lot.

C.   Variance to increase the Floor Area Ratio of the building.

Recommended motion: Approve the variance to increase the Floor Area Ratio of the building from 4.8 to 5.32.

D.   Site plan review for a new office building.

Recommended motion: Approve the site plan review for a new office building with ground floor commercial space, subject to the following conditions:

1.     Approval of the final site, landscaping, elevation and lighting plans by the Department of Community Planning and Economic Development.

2.     All site improvements shall be completed by April 27, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

E.    Preliminary and final plat.

Recommended motion: Approve the preliminary and final plat, subject to the following conditions:

1.     The Reciprocal Easement Agreement shall be recorded with Hennepin County.

2.     All development shall be approved as part of a Planned Unit Development or the land shall be replatted or otherwise arranged to meet the street frontage requirements of Chapter 598, Land Subdivision Regulations.

8.    Brickhouse Lofts, 150 26th Ave SE, Ward 2.

This item was continued from the April 13, 2015 meeting.

Staff report by Kimberly Holien, BZZ-6999 and PL-289

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Maxwell Ventures, LLC.

A.   Conditional use permit for a planned unit development.

Recommended motion: Approve the conditional use permit for a planned unit development with 313 dwelling units, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     As required by section 527.120 of the zoning code, the development shall comply with the standards for some combination of the following amenities from Table 527-1, Amenities totaling a minimum of 15 points: Conservation of the Built Environment, Outdoor Open Space, Reflective Roof, Decorative Fencing and Recycling Storage Area.  

3.     The applicant shall implement all amenities as required by section 527.120 of the zoning code by April 27, 2017. 

4.     The north and west elevations of the Maxwell building addition shall step back a minimum of five feet from the building edge to reduce off-site impacts regarding shadowing, access to light and air for adjacent properties and wind currents are ground level. 

B.   Variance to the minimum ground floor window requirements of the PO, Pedestrian Oriented Overlay district.

Recommended motion: Return the variance to the standards of the Pedestrian Oriented Overlay district. 

C.   Site plan review.

Recommended motion: Approve the site plan review for a planned unit development with 313 dwelling units and additions to each building, subject to the following conditions:

1.     CPED Staff review and approval of the final site plan, lighting plan, landscaping plan, and elevations before permits may be issued. 

2.     All site improvements shall be completed by April 27, 2017, unless extended by the Zoning Administrator, or permits may be revoked for noncompliance.

3.     Primary exterior material changes at a later date may require review by the Planning Commission and an amendment to the site plan review.

4.     The corrugated metal siding proposed on the industrial building shall be replaced with an alternate durable material, in compliance with Section 530.120 of the zoning code.

D.   Plat.

Recommended motion: Approve the preliminary and final plat for the planned unit development.

9.    L & H Station, 2225 E Lake St, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by BKV Group, Inc., on behalf of Hennepin County.

A.   Conditional use permit for a Planned Unit Development in the C3A (Community Activity Center) District and PO (Pedestrian-Oriented) Overlay District.

Recommended motion: Continue to the application until the May 11, 2015, City Planning Commission meeting. 

B.   Site plan review to allow for the construction of the first phase of a multi-phase development that includes office and commercial space, structured parking and a total of 125 residential units.

Recommended motion: Continue to the application until the May 11, 2015, City Planning Commission meeting. 

C.   Preliminary plat.

Recommended motion: Continue to the application until the May 11, 2015, City Planning Commission meeting.
