APPROVAL OF AGENDA

COMMITTEE OF THE WHOLE CONSENT AGENDA ITEMS - NOVEMBER 5, 2015

1.    Land Sale – 815.5 25th Ave S (Approval) 

Staff report by Haila Maze

Review for consistency with the Comprehensive Plan the sale of 815.5 25th Ave S for green space for adjacent commercial property.

Recommended motion: Approve the staff report – the item is consistent with The Minneapolis Plan for Sustainable Growth.

2.    Land Acquisition – MnDOT land at southeast corner of 27th Ave NE and University Ave NE (Approval)

Review for consistency with the Comprehensive Plan the acquisition of currently unplatted land owned by MnDOT and located at the southeast corner of 27th Ave NE and University Ave NE, for assemblage with adjacent City-owned property for the development of an East Side maintenance facility.

Recommended motion: Approve the staff report – the item is consistent with The Minneapolis Plan for Sustainable Growth.

3.    Land Sale – 609 Fillmore St NE (Approval)

Review for consistency with the Comprehensive Plan the sale of 609 Fillmore St NE for the development of a single family home.

Recommended motion: Approve the staff report – the item is consistent with The Minneapolis Plan for Sustainable Growth.

4.    Land Acquisition – 2547 5th St NE (Approval)

Review for consistency with the Comprehensive Plan the acquisition of 2547 5th St NE, for assemblage with adjacent City-owned property for the development of an East Side maintenance facility.

     Recommended motion: Approve the staff report – the item is consistent with The Minneapolis Plan for Sustainable Growth.

1.    Mount Olivet Careview Home Addition, 5517 Lyndale Ave S, Ward 11

This item was continued from the November 2, 2015 meeting.

Staff report by Kimberly Holien, BZZ-7408.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Dave Wolterstorff of WAI Continuum.

A.   Conditional use permit for a board and care home/nursing home/assisted living facility.

Recommended Motion: Approve the application for a conditional use permit, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The applicant is encouraged to prepare a campus master plan identifying any proposed additions or major alterations over the next ten years. 

B.   Conditional use permit to increase height.

Recommended Motion: Approve the application for a conditional use permit, subject to the following conditions: 

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.   Variance to reduce the south interior side yard setback.

Recommended Motion: Deny the application for a variance.

D.   Site plan review.

Recommended Motion: Approve the application for site plan review, subject to the following conditions:

1.     All site improvements shall be completed by November 16, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED Staff shall review and approve the final site, elevation, landscaping and lighting plans before building permits may be issued.

3.     Windows shall be provided on the east elevation to reduce the length of the blank wall and provide for even distribution of windows, in compliance with Section 530.120 of the zoning code. 

4.     The arches above the windows on the fifth floor of the west elevation shall be removed to provide for even distribution, in compliance with Section 530.120 of the zoning code. 

5.     A minimum of seventeen additional shrubs shall be planted in the landscaped yard between the addition and Lyndale Ave S for an overall site total of 118 shrubs, in compliance with Section 530.110 and Section 530.160 of the zoning code.

6.     The landscaped yard between the east parking area and Garfield Ave S shall contain plantings that are a minimum of three feet in height and 60 percent opaque for the length of the yard, in compliance with Section 530.170 of the zoning code.

7.     All rooftop mechanical equipment shall be screened in compliance with Section 535.270 of the zoning code. 

2.    Alma Building, 528 University Ave SE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Alexander Roberts.

A.   Petition to rezone the property from R5 to C1.

Recommended Motion: Approve the petition to rezone the property located at 528 University Ave SE from the R5 Multiple-family District to the C1 Neighborhood Commercial District.

B.   Variance of the interior side yard requirement adjacent to the west lot line.

Recommended Motion: Approve the application for a variance to reduce the minimum interior side yard requirement adjacent to the westerly lot line from 5 feet to 2 feet to allow a refuse storage area and enclosure.

C.   Variance of the rear yard requirement adjacent to the south lot line.

Recommended Motion: The application for a variance to reduce the minimum rear yard requirement adjacent to the southerly lot line from 5 feet to 2 feet to allow a refuse storage area and enclosure has been withdrawn.

D.   Variance of the development standards.

Recommended Motion: Approve the application for a variance of the development standards for a hotel requiring an office or lobby that is staffed 24 hours per day to allow oncall staff member between the hours of 2:00 am and 5:00 am.

3.    Northeast Park Recreation Building, 1500-1520 Johnson St NE and 1601 Fillmore St NE, Ward 1

Staff report by Shanna Sether, BZZ-7462.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Perkins + Will.

A.   Site plan review.

Recommended Motion: Approve the application for a new recreation building, subject to the following conditions:

1.     The applicant shall provide a minimum of one deciduous or coniferous tree, for each 25 feet of parking lot frontage and a minimum of 76 shrubs in the landscaped yard adjacent to Johnson St. NE.

2.     The applicant shall provide screening of the parking lot of at least three feet in height and 60% opaque, between the parking lot and Johnson St NE, as required by section 530.170 (b) of the zoning code.

3.     All mechanical equipment shall be arranged so as to minimize visual impact by using screening consistent with section 535.70 of the zoning code.

4.     The refuse and recycling containers shall be screen from view, consistent with section 535.80 of the zoning code.

5.     Lighting shall comply with section 535.590 of the zoning code.

6.     Department of Community Planning and Economic Development staff review and approval of the final building elevations, floor, site, lighting and landscape plans.

7.     Site improvements shall be completed by October 5, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

4.    Wells Fargo, 1505 W Lake St, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Wells Fargo.

A.   Alteration of a non-conforming use.

Recommended Motion: Approve the application for an alteration of non-conforming use.

B.   Variance to increase the maximum parking requirement from 17 spaces to 36 spaces.

Recommended motion: Deny the application for a variance

C.   Variance to increase the maximum allowed height and area of wall signs.

Recommended Motion: Deny the application for a variance.

D.   Variance to increase the maximum allowed height, area and number of freestanding signs.

Recommended Motion: Approve the application for a variance, subject to the following conditions:

1.     The sign panels above the automatic teller machines shall be removed. 

2.     The signs shall not be backlit. 

E.    Site plan review.

Recommended Motion: Approve the application for site plan review, subject to the following conditions:

1.     All site improvements shall be completed by November 16, 2017, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED Staff shall review and approve the final site, elevation, landscaping and lighting plans before building permits may be issued.

3.     A maximum of 17 parking stalls shall be provided on site.  With the exception of the lot fronting along Irving Ave S, all areas where parking stalls are removed shall be landscaped. 

4.     A minimum of three bicycle parking stalls shall be provided near the entrance at the corner of W Lake Street and Humboldt Ave S. 

5.     All required ground floor windows shall maintain a visible light transmittance ratio of 0.6 or higher, in compliance with Section 530.120 of the zoning code.

6.     The landscaped yard between the drive-through and Humboldt Ave S shall contain plantings that are a minimum of three feet in height and 60 percent opaque for the length of the yard, in compliance with Section 530.170 of the zoning code.

7.     Native grasses shall be provided between the southernmost row of parking stalls and the fence, as alternative compliance for the requirements of Section 530.170 of the zoning code. 

8.     All rooftop mechanical equipment shall be screened in compliance with Section 535.270 of the zoning code.
