1.    Land Sales – 2800 – 18th Ave N, 3014 Logan Ave N, 701 Newton Ave N, 916 Newton Ave N, 1715 Oliver Ave N, 1426 Penn Ave N, and 1419 Upton Ave N (Approval) 

Staff report by Jim Voll and Rattana Sengsoulichanh

A.   Review for consistency with the Comprehensive Plan the sale of 2800 – 18th Ave N, 3014 Logan Ave N, 701 Newton Ave N, 916 Newton Ave N, 1715 Oliver Ave N, 1426 Penn Ave N, and 1419 Upton Ave N for the rehabilitation of single family homes.

Recommended motion: Approve the staff report – the item is consistent with The Minneapolis Plan for Sustainable Growth.

1.    Right-of-Way Vacation, Ward 1

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by BNSF Railway Company.

A.   Vacation.

Recommended Motion: Approve the vacation of the right-of-way of Main St NE from 29th Ave NE to 31st Ave NE and the right-of-way of 30th Ave NE from Main St NE, westerly for approximately 128 feet.

2.    Watchman’s Shelter, 240 Morgan Ave N, Ward 5

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Church of Masters Love.

A.   Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit to allow for an accessory overnight shelter, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The applicant shall maintain a management plan for the facility and a floor plan showing sleeping areas, emergency exits, bathing and restrooms.

3.    1701 44th Ave N, Ward 4

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Kevin Aldwaik.

A.   Rezoning.

Recommended Motion: Deny the application for a rezoning from the C1/Neighborhood Commercial District to the C2/Neighborhood Corridor Commercial District.

4.    3748 Park Ave, Ward 8

Staff report by Joe Giant, BZZ-7552.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Colin Hirdman and Paul Hirdman.

A.   Alteration of a nonconforming use.

Recommended Motion: Approve the application for an alteration of a nonconforming use to reconstruct a two-family dwelling in the R1A Single-Family District, subject to the following conditions:

1.     Approval of the final site, elevation, and floor plans by the Department of Community Planning and Economic Development;

2.     All site improvements shall be completed by February 8, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

B.    Variance to reduce the front yard setback.

Recommended Motion: Approve the application to reduce the established front yard setback on a reverse corner lot along 38th St E from 22 feet to 10 feet, measured to the principal structure.

5.    Marissa’s Warehouse, 2728-2750 Nicollet Ave, 2741 Blaisdell Ave S and 10 W 28th St, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Clarison Dutra.

A.   Amendment of an existing conditional use permit for a shopping center.

Recommended Motion: Approve the application for an amendment of a conditional use permit for a shopping center, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.    Variance to increase the maximum gross floor area for commercial uses in the C2 District.

Recommended Motion: Return the application for a variance to increase the maximum gross floor area.

C.   Variance to reduce the required off-street loading requirement.

Recommended Motion: Approve the application for a variance to reduce the minimum off-street loading requirement from one large loading space to none for an existing grocery store, subject to the following condition:

1.     The applicant shall comply with the terms of the Travel Demand Management Plan.

D.   Site Plan Review.

Recommended Motion: Approve the application for site plan review to allow for an addition of approximately 20,000 square feet to an existing commercial building, subject to the following conditions:

1.     The applicant shall provide a window pattern that is compatible with the first floor windows and they shall be vertical in proportion, per section 530.120(b)(2) of the zoning code.

2.     Staff shall continue to work with the applicant on exterior materials, including color, and window design, placement and location to ensure the compatibility between the existing building and the proposed addition. 

3.     The dumpsters, grease barrels and recycling materials shall be screened from view, consistent with section 535.80 of the zoning code.

4.     All mechanical equipment shall be arranged so as to minimize visual impact by using screening consistent with section 535.70 of the zoning code.

5.     Lighting shall comply with section 535.590 of the zoning code.

6.     Department of Community Planning and Economic Development staff review and approval of the final building elevations, floor, site, lighting and landscape plans.

6.    Moxy Uptown, 1121 W Lake St and 3005 Emerson Ave S, Ward 10

This item was continued from the January 25, 2016 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Joshua Jansen of Collage Architects.

A.   Rezoning. 

Recommended Motion: Approve the application for a rezoning from the C2, Neighborhood Corridor Commercial zoning district to the C3A, Community Activity Center zoning district, retaining the PO, Pedestrian Oriented Overlay district.

B.    Conditional use permit to increase the maximum permitted height in the C3A district.

Recommended Motion: Approve the application for a conditional use permit to increase height in the C3A district from 4 stories or 56 feet to 6 stories, 72.5 feet, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The massing of the building shall be as shown in the plans, with the building stepping down to five stories on the south side. 

3.     The deck spaces on the south side of the sixth floor shall be removed. 

C.   Variance to exceed the maximum floor area ratio in the C3A district.

Recommended Motion: Approve the application for a variance to increase the maximum floor area ratio from 2.7 to 3.78.

D.   Variance to reduce the front yard setback along Emerson Ave S.

Recommended Motion: Deny the application for a front yard setback variance to reduce the front yard setback requirement along Emerson Ave S from 15 feet to zero.

E.    Variance to reduce the east rear yard setback.

Recommended Motion: Approve the application for a variance of the east rear yard setback requirement from 15 feet to zero, subject to the following condition:

1.     The building shall step back 1.5 feet on the north end as shown in the plans to provide sightlines where the alley intersects with W Lake St. 

F.    Variance to reduce the minimum loading requirement.

Recommended Motion: Approve the application for a variance to reduce the minimum loading requirement from one large space to zero.

G.   Site plan review.

Recommended Motion: Approve the application for site plan review for a new hotel with 123 rooms, subject to the following conditions:

1.     All site improvements shall be completed by February 8, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.     Windows shall be added on the south side of the office space, facing the parking lot, in compliance with Section 530.120 of the zoning code. 

5.     The building shall maintain a 15-foot front yard setback for the south 25 feet of the property. 

6.     Signage shall be installed that directs exiting vehicles to turn north at the alley.

7.     The use shall maintain a contract with a properly licensed valet provider for parking stalls within 800 feet of the principal entrance. 

7.    Linden Hills Zoning Map and Zoning Code Text Amendment, Ward 13

Staff report by Brian Schaffer.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings.

A.   Amending Title 20, Chapter 521 of the Minneapolis Code of Ordinances Relating to Zoning Code: Zoning Districts and Maps.  Amending Title 20, Chapter 551 of the Minneapolis Code of Ordinances Relating to Zoning Code: Overlay Districts.

Recommended Motion: Approve the zoning text amendments removing the Linden Hills Overlay District and adding the Linden Hills area to the Pedestrian Oriented Overlay District. Approve the zoning map amendment and zoning text amendments for the rezoning of parcels as listed in the staff report attachment and find that obtaining consent signatures for the rezoning of properties from residential to commercial in the Linden Hills Rezoning Study is impractical .
