APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. If you plan to speak to an issue on the agenda, it is recommended that you arrive at the meeting at 4:30 or contact the assigned city staff person in advance. COMMITTEE OF THE WHOLE CONSENT AGENDA ITEMS - DECEMBER 8, 2016

1.    Land Sale – 3751 Logan Ave N (Approval) 

Staff report by Rattana Sengsoulichanh

Review for consistency with the Comprehensive Plan the sale of 3751 Logan Ave N for the rehabilitation of a single-family home.

Recommended motion: Approve the staff report – the item is consistent with The Minneapolis Plan for Sustainable Growth.

2.    Land Sale – 2424 12th Ave S (Approval)

1.    Metro Transit, Ward 5

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Metro Transit.

A.   Vacation.

Recommended Motion: Approve the vacation of a utility easement retained as part of the vacation of a portion of N 6th St and 7th Ave N, subject to the retention of easements for the City of Minneapolis and Xcel Energy.

2.    2204 Marshall St NE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Philip Harder.

A.   Conditional use permit.

Recommended Motion: Approve the conditional use permit to allow a dock to be located in the FP Floodplain Overlay District, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The applicant shall demonstrate that all necessary permits have been obtained from the Minnesota Department of Natural Resources.

3.    3216 Lyndale Ave S, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Brian and Pathakone Wagner.

A.   Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit to increase the maximum height of a building from 2.5 stories to 3 stories to allow a dormer addition that does not comply with the half-story definition, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

4.    @Glenwood, 225, 297 and 301 Thomas Ave N; 2601 Glenwood Ave N; 2700 2nd Ave N; and 110 Russell Ave N, Ward 5

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by @Glenwood LLC.

A.   Petition to rezone part of 110 Russell Ave N and 2700 2nd Ave N from R1A to I1.

Recommended Motion: Approve the petition to rezone part of 110 Russell Ave N and 2700 2nd Ave N from R1A to I1.

B.   Conditional use permit for minor auto repair in an existing building. 

Recommended Motion: Approve the application for a conditional use permit to allow minor automobile repair, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.   Site plan review.

Recommended Motion: Approve the application for site plan review to allow minor automobile repair, subject to the following conditions:

1.     All site improvements shall be completed by February 10, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site and landscaping plans before building permits may be issued.

D.   Minor subdivision to allow a lot line adjustment for 110 Russell Ave N and 2700 2nd Ave N.

Recommended Motion: Approve the minor subdivision.

5.    4700 Cedar Retail Addition and Renovation, 4700-4714 Cedar Ave S, Ward 11

This item was continued from the December 5, 2016 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Momentum Design Group.

A.   Site plan review.

Recommended Motion: Continue the application for an approximately 2,300 square foot addition to the January 23, 2017, City Planning Commission meeting.

6.    Aspro Auto Sales, 1300 Lake St E, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Nieves Rivera of New York Plaza, LLC.

A.   Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The proposed automobile sales will comply with section 536.20 Specific Development Standards in the zoning code.

B.   Site plan review.

Recommended Motion: Return the application for site plan review.

7.    401 Nicollet Mall, 401 Nicollet Mall and 47 S 4th St, Ward 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Xcel Energy.

A.   Conditional use permit.

Recommended Motion: Approve the application for an accessory surface parking lot located in the DP Downtown Parking Overlay District, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     A raised concrete planter shall be installed between the parking spaces and the property line along S 4th St.

3.     The landscape materials within the planter shall screen vehicles from the public right-of-way.

B.   Site plan review.

Recommended Motion: Approve the application for an accessory surface parking lot, subject to the following conditions:

1.     All site improvements shall be completed by January 9, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final landscaping plans before building permits may be issued.

3.     The planter along S 4th St shall be at least 16 feet in width and eight feet deep.

8.    The Aberdeen, 1321 5th Ave S, Ward 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by St. Paul Development Corporation.

A.   Variance to reduce the minimum front yard requirement adjacent to 5th Ave S.

Recommended Motion: Approve the application for a variance to reduce the required front yard setback along 5th Ave S from 15 feet to 2 feet.

B.   Variance to reduce the minimum corner side yard requirement adjacent to 14th St E.

Recommended Motion: Approve the application for a variance to reduce the required corner side yard setback along E 14th St from 15 feet to 1 foot subject to the following conditions:

1.      The applicant shall modify to design of the terrace partitions along E 14th St to a height of no more than 4 feet.

C.   Variance to reduce the rear yard requirement.

Recommended Motion: Approve the application for a variance to reduce the required rear yard setback from 13 feet to 10 feet.

D.   Site plan review to allow a new 50 unit residential building.

Recommended Motion: Approve the application for a new 50 unit residential building, subject to the following conditions:

1.     All site improvements shall be completed by January 9th 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.     All building elevations shall comply with the exterior building material standards contained in chapter 530.120 of the zoning code including not utilizing more than 30% lap siding per elevation.

5.     All signage shall comply with chapter 543, On Premises Signs.  As such the applicant shall provide not more than 2 non-illuminated, flat wall identification sign not exceeding thirty-two (32) square feet.

6.     The final lighting plan shall conform to the standards of Chapter 535, Regulations of General Applicability

7.     Roof top mechanical equipment shall be screened as required by Chapter 535, Regulations of General Applicability.

E.    Minor subdivision to allow a lot line adjustment.

Recommended Motion: Approve the application for a minor subdivision.

9.    Holmes Ave Apartments, 3009-3013 Holmes Ave S, Ward 10

Staff report by Peter Crandall, PLAN-3370

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Curt Gunsbury.

A.   Conditional use permit to increase the maximum building height.

Recommended Motion: Approve the application for a conditional use permit to increase the maximum height of the building from 4 stories, 56 feet to 9 stories, 90 feet, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.   Variance to increase the maximum floor area ratio.

Recommended Motion: Approve the application to increase the maximum floor area ratio

from 3.24 to 4.6.

C.   Variance to reduce the north side yard setback.

Recommended Motion: Approve the application for a variance to reduce the north side yard

setback from 15 feet to 5 feet.

D.   Variance to reduce the south side yard setback.

Recommended Motion: Approve the application for a variance to reduce the south side yard

setback from 15 feet to 5 feet.

E.    Variance to reduce the rear yard setback.

Recommended Motion: Approve the application for a variance to reduce the rear yard

setbacks from 15 feet to 1 foot.

F.    Variance to increase the maximum number of compact parking spaces.

Recommended Motion: Approve the application for a variance to maximum percentage of

compact parking spaces from 25% to 90%.

G.   Site plan review to allow a new 71 unit residential building.

Recommended Motion: Approve the application for a new 71 unit residential building, subject

to the following conditions:

1.     All site improvements shall be completed by January 9th, 2019, unless extended by the

Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans

before building permits may be issued.

3.     The plant materials, and installation and maintenance of the plant materials, shall comply

with sections 530.200 and 530.210 of the zoning code.

4.     All building elevations shall comply with the exterior building material standards contained in

chapter 530.120 of the zoning code, including not utilizing more than 30% lap siding per

elevation.

5.     The applicant shall provide a final lighting plan that conforms to the standards of Chapter

535, Regulations of General Applicability.
