APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. If you plan to speak to an issue on the agenda, it is recommended that you arrive at the meeting at 4:30 or contact the assigned city staff person in advance. 1.    Appointments to the Zoning Board of Adjustment (Approval)

Recommend that the City Council approve the following appointments to the Zoning Board of Adjustment for terms to expire December 31, 2019:  Sean Cahill, John Finlayson, and Dan Ogiba.

2.    Land Sale and Acquisition – East Side Storage and Maintenance Facility (Approval)

ACTION

1.    L&H Station Development L.L.C. & Hennepin County Housing and Redevelopment Authority, 2225 Lake St E, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission accept the resolution and approve the waiver of subdivision requirements as requested by L&H Station Development L.L.C. and Hennepin County Housing and Redevelopment Authority.

A.   Waiver of Subdivision Requirements.

Recommended Motion: Approve the waiver of subdivision requirements for the immediate conveyance of the parcel of land legally described on Exhibit B (the Housing Parcel) to L&H Station Development L.L.C. in order to facilitate the timely construction and completion of the housing building.

1.    Seventeen10 RLS, 1710 W Lake St, Ward 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Seventeen10, LLC.

A.   Registered land survey.

Recommended Motion: Approve the registered land survey application, subject to the following conditions:

1.     This RLS creates tracts (namely Tract B) that, if separately redeveloped, would not meet the requirements of the zoning and subdivision ordinance for lot frontage on a public street. Approval of this RLS does not constitute approval for the separate redevelopment of any tract if such tract does not comply with applicable subdivision ordinances.

2.     This action of the Planning Commission shall be recorded with Hennepin County at or prior to such time as the signed RLS is presented for recording with Hennepin County. 

2.    Right-of-way vacation, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission accept the withdrawal of the application by Carol Lansing.

A.   Vacation.

Recommended Motion: The application for a vacation of E 29th St between 21st Ave S and the Metro Transit Blue Line has been withdrawn

3.    4700 Cedar Retail Addition and Renovation, 4700-4714 Cedar Ave S, Ward 11

This item was continued from the December 5, 2016 and January 9, 2017 meetings.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Momentum Design Group.

A.   Site plan review.

Recommended Motion: Continue the application to the February 6, 2017, City Planning Commission meeting.

4.    Holiday Dynamic Sign, 1617 Broadway St NE and 1209 Ulysses St NE, Ward 1

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Holiday Stationstores.

A.   Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit to allow a dynamic sign, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.   Variance.

Recommended Motion: Approve the application for a variance to increase the maximum height of a dynamic sign from 14 feet to 20 feet, 2 inches.

5.    Uptown mixed-use development, 3453 Hennepin Ave, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Randall Fielding.

A.   Rezoning.

Recommended Motion: Approve the application for a petition to rezone the property located at 3453 Hennepin Ave from the R2B District to the OR1 District.

B.   Conditional use permit.

Recommended Motion: Approve the application to allow for an increase in height from 2.5 stories or 35 feet to three stories and 34 feet in the OR1 District, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.   Variance to reduce the front yard setback along Hennepin Ave.

Recommended Motion: Approve the application for a variance to reduce the required front yard setback along Hennepin Ave from 31 feet to 13 feet for the building and from 31 feet to 5 feet for a first floor deck.

D.   Variance to reduce the corner yard setback along W 35th St.

Recommended Motion: Approve the application for variance to reduce the corner yard setback from 12 feet to 0 feet along W 35th St for the building and first floor deck, and from 5 feet to 1.5 feet for the proposed driveway and parking area, subject to the following condition:

1.     The landscaping proposal shall be implemented as proposed along the southern property line.

E.    Variance of the drive aisle requirement.

Recommended Motion: Approve the application for variance to allow for maneuvering in the alley for a nonresidential use, subject to the following condition:

1.     The width of the surface parking spaces shall not be less than 9 feet to allow adequate room for maneuvering.

F.    Site plan review.

Recommended Motion: Approve the application for a mixed-use building with office space and three residential units, subject to the following conditions:

1.     All site improvements shall be completed by February 24, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     A minimum of 10 bike parking spaces shall be provided as proposed and the bicycle racks and base shall be located at least five feet from the north interior property line. The applicant is proposing to provide bike parking for 10 bicycles.

4.     The air conditioning units in the interior side yard shall be screened in compliance with Section 535.70-Screening of mechanical equipment.

5.     The refuse and recycling storage containers be screened in compliance with Section 535.80.

6.     All lighting shall comply with lighting standards in Chapter 535 and Chapter 541 and the lighting directed on the façade of the building shall be located, aimed and shielded so that light is directed only onto the facade or roof.

6.    Village Market, 2301 Elliot Ave, 912 E 24th St, 2218 10th Ave S, 2320 10th Ave S, Ward 6

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Omar Sabri with Eagle Management.

A.   Expansion of a non-conforming use.

Recommended Motion: Approve the application to allow a covered porch and other exterior site work to the existing shopping center in the I1 Light Industrial zoning district.

B.   Site plan review.

Recommended Motion: Approve the application for a covered porch and other exterior site work, subject to the following conditions:

1.     All site improvements shall be completed by January 23, 2018, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     In order to provide access from East 24th Street to the entrances along the east side of the building, a four-foot wide, raised sidewalk shall be constructed along the east side of the covered porch that connects to the other walkways on the east side of the site.

4.     A four-foot wide, raised sidewalk shall be constructed along the south side of the grocery store that connects the public sidewalk along 10th Avenue South to the other walkways on the east side of the site.

5.     The outside dimensions of the curb cut and driveway along Elliot Avenue South shall align with the parking spaces.

6.     A seven-foot wide landscaped yard shall be installed along both East 24th Street and 10th Avenue South.

7.     A decorative fence, similar to what is located around the perimeter of the on-site parking lot, and landscaping that grows to a height of at least three feet and is at least 60 percent opaque, shall be installed along both East 24th Street and 10th Avenue South.

8.     The curbing shall be removed from the perimeter of the loading area and it shall be designed so stormwater runoff drains towards the perimeter landscaped yards.
