APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. If you plan to speak to an issue on the agenda, it is recommended that you arrive at the meeting at 4:30 or contact the assigned city staff person in advance. Please contact CPED staff with any questions that you have about the consent agenda.

1.    4839 Girard Ave S, Ward 13

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Rod Helm.

A.   Minor subdivision.

Recommended Motion: Approve the application for a minor subdivision, subject to the following condition:

1.     Staff will not release the minor subdivision resolution for recording until after the existing garage is removed or relocated.  The applicant is required to complete the work on the existing garage and record the resolution or the minor subdivision approval will expire, February 21, 2019.

2.    3416 Chicago Ave, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Alexander Gladkov.

A.   Rezoning.

Recommended Motion: Approve the application to rezone the property located at 3416 Chicago Ave S from the R2B Two-Family District to the R4 Multiple-Family District.

3.    Q’Coffee, 1418 E Lake St, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Osman & Lul Properties, LLC.

A.   Site plan review.

Recommended Motion: Approve the application for an addition to an existing commercial building, subject to the following conditions:

1.     All site improvements shall be completed by February 21, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The applicant shall provide a minimum of 3 bicycle parking spaces, not less than 50% of which shall meet the definition for short-term bicycle parking, as required by section 541 of the zoning code.

4.     The applicant shall replace the existing refuse screening along 15th Ave S with a screening condition that meets the requirements of chapter 535.80.

5.     The applicant shall provide a final lighting plan that conforms to the standards of Chapter 535, Regulations of General Applicability.

4.    4700 Cedar Retail Addition and Renovation, 4700-4714 Cedar Ave S, Ward 11

This item was continued from the December 5, 2016, January 9, January 23, February 9, 2017 meetings.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Momentum Design Group.

A.   Site plan review.

Recommended Motion: Approve the application for a new approximately 2,300 square foot building, subject to the following conditions:

1.     All site improvements shall be completed by February 21, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     A direct entrance shall be provided from the public sidewalk on Cedar to the door facing Cedar, as required by section 530.110 of the zoning code. The patio fence shall either be removed or a break shall be provided directly east of the door to provide direct access from the public sidewalk.

4.     The entrance on Cedar shall be designed as the principal entrance through the use of a canopy feature similar to that currently shown on the northern entrance, in compliance with section 530.120 of the zoning code.

5.     At least 15 feet of brick shall be incorporated on the south elevation near the southwest corner of the building, to comply with section 530.120 of the zoning code.

6.     The brick bands on the existing building shall remain so as not to create blank walls, in compliance with section 530.120 of the zoning code.

7.     The crosswalk between the new building and existing building shall be elevated and striped, to comply with section 530.150 of the zoning code.

8.     A 4.5 foot wide landscaped yard shall be provided along Cedar to meet the intent of section 530.170 of the zoning code.

9.     Four ornamental trees shall be provided in the landscaped yard along Cedar, to meet the intent of section 530.170 of the zoning code.

10.  A lighting plan indicating compliance with section 535.590 of the zoning code shall be provided prior to the issuance of any building permits.

5.    Estes Funeral Chapel, 2201 and 2215 Plymouth Ave N and 1245 Penn Ave N, Ward 5

A.   Conditional use permit.

Recommended Motion: Continue the application to the March 6, 2017 Planning Commission meeting.

B.   Variance to reduce the front yard setbacks along Penn and Queen Aves N.

Recommended Motion: Continue the application to the March 6, 2017 Planning Commission meeting.

C.   Variance to reduce the corner side yard setback along Plymouth Ave N.

Recommended Motion: Continue the application to the March 6, 2017 Planning Commission meeting.

D.   Site plan review.

Recommended Motion: Continue the application to the March 6, 2017 Planning Commission meeting.

E.    Alley vacation.

Recommended Motion: Continue the application to the March 6, 2017 Planning Commission meeting.

6.    Ironclad, 811 Washington Ave S, 243-249 Chicago Ave S, and 800½ 3rd St S, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Collage Architects.

A.   Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit to increase maximum height from 10 stories or 140 feet to 14 stories, 148 feet, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.   Variance.

Recommended Motion: Approve the application for a variance to reduce the northeast interior side yard requirement from 15 feet to 4 feet for residential windows on floors three through ten.

C.   Site plan review.

Recommended Motion: Approve the application for a new mixed use building, subject to the following conditions:

1.     All site improvements shall be completed by February 21, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     Blank, uninterrupted walls on the south elevation shall not exceed twenty-five (25) feet in length, in compliance with section 530.120 of the zoning code.

4.     The first floor windows of the nonresidential portions of the building shall have clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher, in compliance with section 530.120 of the zoning code.

5.     The historic retaining wall shall be incorporated along Chicago Ave and part of Washington Ave S as indicated in the plans. In addition, the northeast corner of the retaining wall shall be incorporated to delineate the historic corner of the wall in order to meet the intent of section 530.270 of the zoning code. The applicant also shall incorporate one or more interpretive signs on site to describe the history of the property.

6.     Ornamental grasses and perennials shall be planted along the inactive portions of the building wall facing 9th Ave S.
