The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Emily Baker-Orr.

A.   Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit to allow a bed and breakfast home in the R4/Multiple-Family District, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.    Downtown East Commons, 521 4th St S and 425 Portland Ave, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by the City of Minneapolis.

A.   Variance.

Recommended Motion: Approve the application for variance to increase the number of freestanding signs in The Downtown East Commons Park from one per block to three on the west block and four on the east block, subject to the following conditions:

1.     There shall not be more than three freestanding signs on the west block of the park.

3.    Estes Funeral Chapel, 2201 and 2215 Plymouth Ave N and 1245 Penn Ave N, Ward 5

This item was continued from the February 21, 2017 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Hennepin County Facilities Department.

A.   Conditional use permit.

Recommended Motion: Approve the conditional use application to allow for a new funeral home in the OR2 District, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.    Variance to reduce the front yard setback along Penn Ave.

Recommended Motion: Approve the application for a variance to reduce the established front yard setback along Penn Ave N from 28 feet 5 inches to 12 feet 7 inches for the proposed building, subject to the following condition:

1.     The applicant shall provide and maintain a landscaped buffer along the south property line with shrubs of at least 3 feet in height.

C.   Variance to reduce the front yard setback along Queen Ave N.

Recommended Motion: Approve the application for a variance to reduce the established front yard setback along Queen Ave N from 31 feet 10 inches to 9 feet 8 inches for the proposed parking area, subject to the following conditions:

1.     The applicant shall provide and maintain a landscaped buffer along the south property line with shrubs of at least 3 feet in height, where adjacent to residential.

2.     The applicant shall provide additional landscaping at the southwest corner of the parking lot.

D.   Variance to reduce the corner side yard setback along Plymouth Ave N.

Recommended Motion: Approve the application for a variance to reduce the corner side yard setback along Plymouth Ave N from 12 feet to 5 feet 9 inches for the proposed building and 7 feet 9 inches for the proposed parking area.

E.    Site plan review.

Recommended Motion: Approve the application for the new construction of a funeral home, subject to the following conditions:

1.     All site improvements shall be completed by March 6, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.     The applicant shall provide additional 5 ornamental trees in the landscaped yards between the building and lot lines along Penn and Plymouth Aves N, in order to create visual interest.

5.     The applicant shall provide perennials between the parking area and the alley, along the proposed south interior property line.  

6.     The applicant shall provide a lighting plan to ensure compliance with section 535.590 of the zoning code. In addition, the applicant shall provide sufficient lighting on the building walls, adjacent to Penn and Plymouth Aves N to increase surveillance of the area.

F.    Alley vacation.

Recommended Motion: Approve the application for a vacation of the public alley.

4.    YMCA Expansion and Signage, 651 Nicollet Mall, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by YMCA.

A.   Conditional use permit to allow a dynamic sign.

Recommended Motion: Approve the application for a conditional use permit to allow a dynamic sign, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     To ensure the sign would not be confused with a traffic signal, it shall not be located in the first or second window bay starting from 6th Street South.

3.     Unless otherwise authorized by the City Planning Commission, the sign shall comply with all requirements of Chapter 543 of the zoning code.

B.    Variance of the dynamic sign standards for duration.

Recommended motion: Deny the application for a variance of the dynamic sign standards to allow sign messages that remain static for a period of less than 60 seconds.

C.   Variance of the dynamic sign standards for luminance.

Recommended motion: Deny the application for a variance of the dynamic sign standards to allow the dynamic sign to display messages or be illuminated when the use is closed.

D.   Site plan review.

Recommended Motion: Approve the application for a site plan review application to allow additions to an existing building, subject to the following conditions:

1.     Department of Community Planning and Economic Development staff review and approval of the final building elevations, floor, site, and lighting plans.

2.     Site improvements required by Chapter 530 or by the City Planning Commission shall be completed by March 6, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

5.    Rosella’s, 2700 Cedar Ave S, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Phillip’s Garden.

A.   Rezoning.

Recommended Motion: Approve the application to rezone the property from the R2B Two-family District to the C1 Neighborhood Commercial District.

B.    Conditional use permit for a contractor’s office.

Recommended Motion: Approve the application for a contractor’s office, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The applicant is encouraged to eliminate one of the access points to the on-site parking lot.

C.   Conditional use permit to increase the maximum permit height of the structure.

Recommended Motion: Return the application to increase the maximum permitted height of the structure from 2.5 stories/35 feet to 3 stories/35 feet.

D.   Variance.

Recommended Motion: Approve the application to reduce the south interior side yard setback from the required 9 feet to 4 feet for an eave overhang.

E.    Site plan review.

Recommended Motion: Approve the application for a new mixed-use building including a contractor’s office and a dwelling unit, subject to the following conditions:

1.     All site improvements shall be completed by April 14, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The walkway that connects the public sidewalk to the building entrance on the back side of the building shall be at least four feet in width as required by section 530.130 of the zoning code.

4.     The applicant is encouraged to eliminate one of the access points to the on-site parking lot.

5.     A landscaped yard of at least seven feet in width shall be installed along E 27th St as required by section 530.170 of the zoning code.

6.     The plant materials, and the installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

7.     The eight-foot front yard setback shall be maintained along E 27th St.

8.     The trash and recycling area shall be located along the alley, outside of the required front yard, and it shall be enclosed.

9.     The final lighting plan shall conform to the standards of Chapter 535, Regulations of General Applicability.

10.  The fence along East 27th Street shall only be three feet high if solid and only four feet high if less than 60 percent opaque.

11.  The applicant shall plant two trees in the landscaped area along E 27th St.

6.    MPS Adult Education & Transition Plus Building, 2005-2019 E Lake St, 3013-3017 20th Ave S, and 3008-3016 21st Ave S, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Urbanworks Architecture.

A.   Rezoning 2005-2019 E Lake St from C1 Neighborhood Commercial District to C2 Neighborhood Corridor Commercial District.

Recommended Motion: Approve the application to rezone the properties located at 2005-2019 East Lake Street from C1 District to C2 District and retain the PO Overlay District.

B.    Rezoning 3013-3017 20th Ave S and 3008-3016 21st Ave S from R2B Two-Family District to C2 Neighborhood Corridor Commercial District, removing the Transitional Parking Overlay District from 3008 21st Ave S.

Recommended Motion: Approve the application to rezone the properties at 3013-3017 20th Ave S and 3008-3016 21st Ave S from R2B District to C2 District, removing the TP Overlay District from 3008 21st Ave S, and retaining the PO Overlay District.

C.   Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit to allow a School, K-12 use in the C2 District, subject to the following condition:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

D.   Variance.

Recommended Motion: Approve the application for a variance of the PO Pedestrian Oriented Overlay District standards to allow over 40 feet of linear parking frontage along public streets, subject to the following condition:

1.     The perimeter of the parking lot shall be landscaped and screened as required by section 530.170 of the zoning code.

E.    Site plan review.

Recommended Motion: Approve the application for an approximately 87,000 square foot educational building, subject to the following conditions:

1.     All site improvements shall be completed by April 14, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.     The applicant shall provide additional pedestrian-level lighting along the building walls facing 20th and 21st Aves S to increase visibility and security.

5.     This transformer shall be screened as required by section 535.70 of the zoning code.

F.    Preliminary plat.

Recommended Motion: Approve the application for a preliminary plat, subject to the following condition:

1.     The final plat shall be amended to remove the reference to 30 ½ Street East as being vacated, if the street vacation is not approved.

G.   Vacation of 30 ½ St E between 20th Ave S and 21st Ave S (Vac-1667).

Recommended motion: Deny the vacation of E 30 ½ St between 20th Ave S and 21st Ave S.

H.   Vacation of an existing alley (Vac-1668).

Recommended motion: Approve the vacation of the alley, subject to the retention of easements by CenturyLink, Verizon, and Comcast.

7.    212 James Redevelopment, 212 James Ave N and 208-226 Irving Ave N, Ward 5

A.   Rezone the southern portion of 212 James Ave N from R5 Multiple Family District to C1 Neighborhood Commercial District.

Recommended Motion: Continue the application to the March 20, 2017, City Planning Commission meeting.

B.    Rezone the northern portion of 212 James Ave N to add the Transitional Parking Overlay District.

Recommended Motion: Continue the application to the March 20, 2017, City Planning Commission meeting.

C.   Rezone 226 Irving Ave N from R3 Multiple-Family District to R5 Multiple-Family District.

Recommended Motion: Approve the zoning code text amendment to increase the per-meeting stipend paid to members of the City Planning Commission and Zoning Board of Adjustment, amending the following chapter:
