Recommended Motion: Approve the application for variance to increase the number of freestanding signs in The Downtown East Commons Park from one per block to three on the west block and four on the east block, subject to the following condition:

1.     There shall not be more than three freestanding signs on the west block of the park.

4.    3241 Cedar Ave, Ward 9

A.   Rezoning.

Recommended Motion: Approve the application to rezone the property located at 3241 Cedar Ave S from the R2B/Two-Family District to the R3/Multiple-Family District.

5.    Wall Development Company LLC Subdivision, 504 29th Ave SE, 501 & 518 Malcolm Ave SE, Ward 2

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Wall Development Company LLC.

A.   Minor subdivision.

Recommended Motion: Approve the application for a minor subdivision.

6.    2009-2017 Lyndale Ave S Apartments, 615 Franklin Ave W and 2005, 2009, 2015 and 2017 Lyndale Ave S, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by CPM Development.

A.   Conditional use permit.

Recommended Motion: Approve the application to increase the height of the building from the permitted 4 stories or 56 feet to 6 stories or 66 feet, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence.  

      Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.   Variance to increase the maximum Floor Area Ratio (FAR).

Recommended Motion: Approve the application to increase the maximum floor area ratio (FAR) from 2.13 to 2.54.

C.   Variance to increase the front yard setback in the PO Pedestrian Oriented Overlay District.

Recommended Motion: Approve the application to increase the front yard setback from the maximum 8 feet to 18 feet in the PO Pedestrian Oriented Overlay District.

D.   Variance to reduce the east rear yard setback for the building.

Recommended Motion: Approve the application to reduce the east rear yard setback from the required 15 feet to 12 feet for the building.

E.    Variance to reduce the minimum parking requirement.

 Recommended Motion: Approve the application to reduce the minimum parking requirement from 37 spaces to 34 spaces.

F.    Site plan review.

Recommended Motion: Approve the application for a new development including 75 dwelling units, subject to the following conditions:

1.     All site improvements shall be completed by March 20, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     There shall be at least 12 shrubs planted on the site as required by section 530.160 of the zoning code.

4.     The proposed fence around the refuse and recycling storage containers and the mechanical equipment shall meet the requirements of Chapter 535 of the Zoning Code. CPED encourages the applicant to use one of the metal panels as the fencing material so it matches the building.

7.    212 James Redevelopment, 212 James Ave N and 208-226 Irving Ave N, Ward 5

This was continued from the March 6, 2017 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Carol Lansing.

A.   Rezoning of 212 James Ave N.

Recommended Motion: Approve the application to rezone the southern portion of 212 James Ave N from the R5 District to the C1 District and to rezone the northern portion of 212 James Ave N to add the TP Overlay District.

B.   Rezoning of 208-226 Irving Ave N.

Recommended Motion: Approve the application to rezone the property located at 226 Irving Ave N from the R3 District to the R5 District and to rezone the properties at 208-226 Irving Ave N to add the TP Overlay District.

C.   Conditional use permit for a Planned Unit Development.

Recommended Motion: Approve the application for a planned unit development including one six-story residential building with 110 dwelling units, one existing office building, and a surface parking area, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     As required by section 527.120 of the zoning code, the development shall comply with the standards for some combination of the following amenities from Table 527-1, Amenities and those proposed by the applicant totaling a minimum of 35 points: Leadership in Energy and Environmental Design (LEED), conservation of the built environment, outdoor children’s play area, pedestrian improvements, reflective roof, enhanced exterior lighting, recycling storage area, decorative street lighting, and a shared vehicle.

D.   Conditional use permit to allow a home occupation for art gallery and studio spaces.

Recommended Motion: Approve the application for a conditional use permit to allow a home occupation within a specific area of the building designated for such use, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

E.    Conditional use permit for a surface parking lot on 212 James Ave N.

Recommended Motion: Approve the application for a conditional use permit to allow a surface parking area at 212 James Ave Nh, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The parking lot shall be landscaped and screened pursuant to the provisions of Chapter 530, Site Plan Review.

F.    Conditional use permit for a surface parking lot on 208-226 Irving Ave N.

Recommended Motion: Approve the application for a conditional use permit to allow a surface parking area at 208-226 Irving Ave N, subject to the following conditions:

1.     The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.     The parking lot shall be landscaped and screened pursuant to the provisions of Chapter 530, Site Plan Review, unless otherwise allowed by the Planning Commission.

G.   Variance.

Recommended Motion: Approve the application for a variance of the TP Transitional Parking Overlay District standards, subject to the following condition:

1.     The parking lot shall be landscaped and screened pursuant to the provisions of Chapter 530, Site Plan Review, except as otherwise allowed by the Planning Commission.

H.   Site plan review.

Recommended Motion: Approve the application for a mixed-use project including the renovation of a portion of an existing building, the construction of a new six-story residential building, and a surface parking area, subject to the following conditions:

1.     All site improvements shall be completed by April 14, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.     CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.     For the residential building, at least one principal common entrance shall face a street and shall be clearly defined and emphasized through the use of architectural features that express the importance of the entrance as required by section 530.120 of the zoning code.

4.     Architectural elements or artistic enhancements shall be provided on the exposed building walls of the parking garage and the retaining wall adjacent to the children’s play area to prevent blank, uninterrupted walls without visual interest exceeding 25 feet in width as required by section 530.120 of the zoning code.  On the west and south facing walls, green screens and/or landscaping with a vertical emphasis that significantly screens the walls may be installed in lieu of architectural elements or artistic enhancements.

5.     At least 20 percent of the net lot area of the PUD shall be landscaped as required by section 530.160 of the zoning code.

6.     The minimum number of on-site trees shall be provided as required by section 530.160 of the zoning code.

7.     The minimum number of required on-site shrubs shall be provided as required by section 530.160 of the zoning code or additional information for the “perennial and shrub beds” ground cover, including specific plant types, shall be provided to ensure that the intent of the landscaping requirements is met.

8.     Shrubs that grow a mature height of 3 feet and provide seasonal interest shall be provided between the 212 James Ave parking lots and each adjacent street as required by section 530.170 of the zoning code.

9.     For the parking lot located at 208-226 Irving Ave, the following improvements shall be provided as required by section 530.170 of the zoning code:

a)     An on-site landscaped yard not less than 7 feet wide with screening that is 3 feet in height and not less than 60 percent opaque between the parking area and Currie Ave and Irving Ave.

b)    At least one tree shall be provided for each 25 linear feet, or fraction thereof, of parking lot frontage.

c)    Along the alley, a 4 foot wide landscaped yard.

d)    Landscaping the corners of the parking lot unavailable for parking or vehicular circulation as specified for a landscaped yard.

e)    Locating each parking space within 50 feet of the center of an on-site deciduous tree.  Any trees islands shall be at least 7 feet in width in any direction.

10.  The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

11.  In the existing parking lot at 208-226 Irving Ave, wheel stops or discontinuous curbing shall be provided as required by section 530.230 of the zoning code. 

12.  A deed restriction, restrictive covenant, or equivalent mechanism shall be filed to ensure the longevity of the affordable units to ensure they qualify for the floor area density bonus.

13.  The north residential lot of 212 James Ave shall comply with the maximum impervious surface requirements of the R5 district. 

14.  All mechanical equipment shall be screened in compliance with Section 535.270 of the zoning code.

15.  A lighting plan indicating compliance with Section 535.590 of the zoning code shall be provided.

16.  The fence around the parking area at 208-226 Irving Ave N shall be reduced to three feet in height in the 15 foot required yard to comply with Section 535.420 of the zoning code. The fence materials shall also comply with section 535.430 of the zoning code.

I.     Preliminary plat.

Recommended Motion: Approve the application for a preliminary plat.
