The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Hennepin Healthcare System.

A.      Variance.

Recommended Motion: Approve the application for a variance to increase the maximum number of allowed freestanding signs from three to four, subject to the following condition:

1.       Approval of the sign permit by the Department of Community Planning and Economic Development.

2.       1721 Como Ave SE, Ward 1

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Mackey Malin Architects.

A.      Variance to reduce the front yard setback along Como Ave SE.

Recommended Motion: Approve the application for a variance to reduce the front yard setback along Como Ave SE from 13 feet 7 inches to 0 feet for the proposed structure.

B.      Variance to reduce the front yard setback along 18th Ave SE.

Recommended Motion: Approve the application for a variance to reduce the front yard setback along 18th Ave SE from 7 feet 1 inch to 7 feet for the proposed parking.

C.      Variance to reduce the minimum off-street parking.

Recommended Motion: Approve the application for a variance to reduce the required off-street parking from 8 stalls to 7 stalls.

D.      Variance to increase the maximum number of compact parking stalls.

Recommended motion: Approve the application for a variance to increase the maximum number of compact parking stalls from 25% to 100%.

E.       Variance to decrease the drive aisle width.

Recommended motion: Approve the application for a variance to reduce the minimum drive aisle width for two-way traffic from 22 ft to 19 ft.

F.       Site plan review.

Recommended Motion: Approve the application for a new mixed-use building, subject to the following conditions:

1.       All site improvements shall be completed by April 24, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall realign the windows so that they are vertical in proportion and are evenly distributed along the building walls on the second and third floors.

4.       The applicant shall provide additional landscaping materials and meet the screening requirements of the parking area along 18th Ave SE

5.       The applicant shall provide a consistent screen along the north and west property lines where adjacent to the parking area allow for effective screening per section 530.160(b) of the zoning code.

6.       All mechanical equipment is enclosed within the building or is screened from the public street by the building itself.

3.       One Thousand 3rd, 1000 3rd St N, Ward 5

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Schafer Richardson.

A.      Conditional use permit.

Recommended Motion: Approve the application to increase the maximum building height from 4 stories, 56 feet to 8 stories, 70 feet, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Variance to reduce the minimum loading requirement.

Recommended Motion: Approve the application to decrease the minimum loading requirement from 2 large spaces to 1 small space.

C.      Variance to increase the maximum height of a wall sign.

Recommended Motion: Approve the application to the maximum height of a wall sign from 28 feet to 70 feet subject to the following condition:

1.       The proposed projecting sign shall be amended to meet the maximum size requirement of 20 square feet.

D.      Site plan review.

Recommended Motion: Approve the application for a 37,719 square foot addition to and renovation of an existing warehouse building, subject to the following conditions:

1.       All site improvements shall be completed by April 24th, 2019 unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall provide discontinuous curbing in the surface parking lot in order to facilitate on-site infiltration of stormwater runoff.

4.       All mechanical equipment shall be screened to meet the standards of section 535.70 of the zoning code.

5.       The applicant shall install pedestrian scale lighting along the 10th Ave N and 3rd St N elevations that meets the requirements of chapter 535 and chapter 541 of the zoning code.

4.       Kappa Sigma Fraternity, 1000 5th St SE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by CPM Companies.

A.      Conditional use permit to establish a fraternity or sorority.

Recommended Motion: Approve the application to establish a fraternity or sorority as a conditional use in the R5 district, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Conditional use permit to increase the maximum height of a fraternity or sorority.

Recommended Motion: Approve the application for a conditional use permit to increase the maximum height of a fraternity or sorority from 2.5 stories, 35 feet to 3 stories, 35 feet, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.      Variance of the specific development standards.

Recommended Motion: Approve the application for a variance to the specific development standards for fraternities and sororities to establish a new fraternity on a zoning lot not used as a fraternity or sorority on the effective date of this ordinance.

D.      Variance of the specific development standards.

Recommended Motion: Approve the application for a variance to the specific development standards for fraternities and sororities to establish a new fraternity that exceeds the maximum number of persons served.

E.       Site plan review.

Recommended Motion: Approve the application for a12 unit addition to an existing residential building to establish a fraternity, subject to the following conditions:

1.       All site improvements shall be completed by May 4th, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall install wheel stops for each parking space in the proposed parking lot.

4.       The applicant shall install refuse screening for any outdoor refuse and recycling storage that meets the requirement of chapter 535 of the zoning code.

5.       The applicant shall provide a photometric lighting plan that meets the requirements and intent of chapters 530 and 535 of the zoning code.

5.       Nordic House, 729 Washington Ave N, 701-729 ½ Washington Ave N, 722-728 3rd St N, 425 ½ 8th Ave N, and 250 ½ 7th Ave N, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by United Properties.

A.      Conditional use permit to allow for a planned unit development.

Recommended Motion: Approve the application to allow for a mixed-use, planned unit development (PUD) that will retain the existing Loose Wiles Building and build a new mixed-use building with 192,000 square feet of new office space, 57 residential units, 24,000 square feet of retail/restaurant space, and 443 off-street parking spaces in the B4N/ Downtown Neighborhood District and DP/ Downtown Neighborhood Overlay District, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The proposed fence along the north property line shall be metal as proposed and shall not obstruct views of the rail corridor to comply with Heritage Preservation Commission approvals.  As required by Section 535.420-Fence height, the proposed fence along the north property line is allowed to be a maximum of 6 feet.

B.      Conditional use permit to allow for an accessory parking lot in the DP/Downtown Neighborhood Overlay District.

Recommended Motion: Approve the application for a conditional use permit to allow for a 20-space surface parking lot in the DP/Downtown Neighborhood Overlay District subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The use of the proposed surface parking as a commercial parking lot shall be prohibited.

C.      Site plan review.

Recommended Motion: Approve the application for a planned unit development that includes the construction of a mixed-use development that will add new office space, residential units, retail/restaurant space, and off-street parking, subject to the following conditions:

1.       All site improvements shall be completed by April 24, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       As required by Section 530.120, shelving, mechanical equipment, and other similar fixtures shall allow views into and out of the building between four and seven feet above the adjacent grade for the required window percentages on the first floor. In addition, the first floor windows shall have clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher.

4.       As recommended by Section 530.250-Site context, CPED encourages the applicant to add site elements within the plaza area to help reduce or mitigate wind currents at ground level.

5.       As required by Section 530.260-Crime prevention through environmental design, the proposed building shall contain pedestrian scaled exterior lighting on all street-facing elevations and the south elevation of Building A. Said lighting shall be mounted on the first story, evenly spaced and directed in a manner that illuminates the ground plane.

6.       The proposed sign package will require heritage preservation commission review prior to sign permit issuance. As required by Table 543-3, projecting signs shall not extend outward from the building more than 4 feet. In addition, window signs shall comply with Section 543.480 in terms of not blocking views between 4 and 7 feet.

7.       As a form of alternative compliance for blank walls, the metal panels that break up the weathering steel panels in the parking structure shall be either recessed or project beyond the main building plane to help increase the visual interest of the structure. 

D.      Preliminary and final plat.

Recommended Motion: Approve the preliminary and final plat.

6.       Malcolm Yards Comprehensive Plan Amendment, 518 Malcolm Ave SE, 501 Malcolm Ave SE, 445 Malcolm Ave SE, 501 30th Ave SE, 419 29th Ave SE, and 504 29th Ave SE, Ward 2
