APPROVAL OF ACTIONS FROM THE APRIL 24, 2017 MEETING

APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. If you plan to speak to an issue on the agenda, it is recommended that you arrive at the meeting at 4:30 or contact the assigned city staff person in advance. COMMITTEE OF THE WHOLE CONSENT AGENDA ITEMS – APRIL 27, 2017

1.       Land Sales – 695-699 Lowry Ave NE

Review for consistency with the Comprehensive Plan the sale of 695-699 Lowry Ave NE for the rehabilitation of an existing building for artist studios and demonstration space, retail, and one three-bedroom apartment

1.       205 Park Apartments, 205 Park Ave, Ward 3

Staff report by Mei-Ling Smith, PLAN 3986

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Gretchen Camp of ESG.

A.      Variance to reduce the rear yard setback.

Recommended motion: Approve the variance application to reduce the rear yard building setback from 15 feet to 8 feet along the east property line.

B.      Variance to reduce the minimum on-site loading requirement.

Recommended motion: Approve the variance reduce the minimum on-site loading requirement from one small space to zero.

C.      Site plan review.

Recommended motion: Approve the application for a six-story, mixed use building with 122 dwelling units and 7,300 square feet of commercial space, subject to the following conditions:  

1.       All site improvements shall be completed by May 8, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall submit a lighting plan showing footcandles before building permits may be issued.

4.       Non-residential ground floor windows shall have clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher.

5.       All new signs are required to meet the requirements of Chapter 543 of the zoning code and separate approvals shall be obtained from CPED.

6.       The blank wall exceeding 25 feet on the east elevation shall be eliminated.

7.       The four-foot wall adjacent to the north and west elevations be mitigated through landscaping or a similar alternative.

2.       Public Dog Park, 711 2nd St S, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Gretchen Camp of ESG.

A.      Variance.

Recommended motion: Approve the variance application to increase the size of a kennel or exercise run from 200 square feet to 1,536 square feet, subject to the following conditions:     

 

1.       The proposed dog run shall be screened from adjacent residential property through landscaping and a six-foot-tall decorative fence, as proposed.

2.       The pet exercise area shall contain accommodations for the proper disposal of animal waste.

3.       501 Lake St E, Ward 9

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by RO Properties, LLC  

A.      Rezoning. 

Recommended motion: Approve the application for a petition to rezone the property from C1 Neighborhood Commercial District to C2 Neighborhood Corridor Commercial District.

4.       Marshall Street Apartments, 1301 Marshall St NE and 107 13th Ave NE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Scott Nelson of DJR Architecture, Inc.

A.      Rezoning.

Recommended motion: Continue the application the May 22, 2017, City Planning Commission meeting.

B.      Conditional use permit.

Recommended motion: Continue the application the May 22, 2017, City Planning Commission meeting.

C.      Variance to increase the maximum floor area ratio.

Recommended motion: Continue the application the May 22, 2017, City Planning Commission meeting.

D.      Variance to reduce the minimum parking requirement.

Recommended motion: Continue the application the May 22, 2017, City Planning Commission meeting.

E.       Variance to increase the percentage of required parking spaces that may be satisfied with compact parking spaces.

Recommended motion: Continue the application the May 22, 2017, City Planning Commission meeting.

F.       Variance to reduce the front yard requirement along the south property line.

Recommended motion: Continue the application the May 22, 2017, City Planning Commission meeting.

G.     Variance to reduce the side yard requirement along the north property line.

Recommended motion: Continue the application the May 22, 2017, City Planning Commission meeting.

H.     Variance to reduce the rear yard requirement along the east property line.

Recommended motion: Continue the application the May 22, 2017, City Planning Commission meeting.

I.        Site plan review.
