APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Fire Barn Associates LLC.

A.      Registered Land Survey.

Recommended Motion: Approve the application for a Registered Land Survey, subject to the following conditions:

1.       The Reciprocal Easement Agreement shall be recorded with Hennepin County.

2.       This action of the Planning Commission shall be recorded with Hennepin County at or prior to such time as the signed RLS is presented for recording with Hennepin County.

2.       Abubakar As-Saddique Islamic Center, 2824 13th Ave S, Ward 9

This item was continued from the July 31, 2017 meeting.

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Abubakar As-Saddique Islamic Center.

A.      Rezoning.

Recommended Motion: Continue the application to rezone the property from I1 to R4 to the August 28, 2017 City Planning Commission meeting.

B.      Conditional use permit.

Recommended Motion: Continue the application for a conditional use permit to establish a new K-12 school to the August 28, 2017 City Planning Commission meeting.

C.      Variance to decrease the front yard setback.

Recommended motion: Continue the application for a variance to reduce the minimum front yard setback along 13th Ave S to the August 28, 2017 City Planning Commission meeting.

D.      Variance to decrease the front yard setback.

Recommended motion: Continue the application for a variance to reduce the minimum front yard setback along 12th Ave S to the August 28, 2017 City Planning Commission meeting.

E.       Site plan review.

Recommended Motion: Continue the application for a renovation and addition to an existing building in order to establish a new K-12 school to the August 28, 2017 City Planning Commission meeting.

3.       3100 Lake Street Apartments, 3100 W Lake St, Ward 7

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Jeff Dawson with 3100 MSP, LLC.

A.      Conditional use permit for a Planned Unit Development.

Recommended Motion: Continue the application for a modification to an existing Planned Unit Development to the September 18, 2017, City Planning Commission hearing.

B.      Site plan review for a new 200-unit residential building.

Recommended Motion: Continue the application a new 200-unit residential building, to the September 18, 2017, City Planning Commission hearing.

4.       3450 Grand Ave S, Ward 8

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Bruce Brunner.

A.      Rezoning.

Recommended Motion: Approve the application to rezone from the R2B Two-Family District to the R3 Multiple-Family District.

5.       Indeed Parking Lot, 1403 Quincy St NE and 814 14th Ave NE, Ward 1

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Kenny Horns of HGA.

A.      Conditional use permit.

Recommended Motion: Approve the application for a principal parking facility in the I2 Medium Industrial District, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The applicant shall provide bicycle racks to support a minimum of 12 bicycles.

B.      Site plan review.

Recommended Motion:  Continue the petition to rezone the properties located at 301 and 311 E Lake Street from the C1 Neighborhood Commercial District to the C2 Neighborhood Corridor Commercial District to the August 28, 2017, City Planning Commission meeting.

B.      Conditional use permit to allow a reception or meeting hall.

Recommended Motion: Continue the conditional use permit application to allow a reception or meeting hall in the C2 Neighborhood Corridor Commercial District to the August 28, 2017, City Planning Commission meeting.

C.      Conditional use permit to allow a shopping center.

Recommended Motion: Continue the conditional use permit application to allow a shopping center in the C2 Neighborhood Corridor Commercial District to the August 28, 2017, City Planning Commission meeting.

D.      Variance to reduce the minimum parking requirement.

Recommended Motion: Continue the variance application to reduce the minimum parking requirement from 114 to 18 vehicle spaces to the August 28, 2017, City Planning Commission meeting.

E.       Variance to reduce the minimum drive aisle requirement.

Recommended Motion: Continue the variance application to reduce the minimum drive aisle requirement from 22 feet to 0 feet to the August 28, 2017, City Planning Commission meeting.

F.       Site plan review.

Recommended Motion: Continue the site plan review application for 5,000 square foot two-story addition to a commercial building to the August 28, 2017, City Planning Commission meeting.

7.       2201 Blaisdell Ave, Ward 10

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Yellow Tree, LLC.

A.      Conditional use permit.

Recommended Motion: Approve the application to increase the height of the building from 4 stories/56 feet to 5 stories/66 feet, subject to the following condition:

3.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

B.      Variance to increase the maximum floor area ratio (FAR) of the building.

Recommended Motion: Approve the application to increase the maximum floor area ratio (FAR) of the building from the 2.4 to2.49.

C.      Variance to reduce the minimum gross floor area of a dwelling unit/efficiency unit.

Recommended Motion: Approve the application to reduce the minimum gross floor area of a dwelling unit from 500 square feet to 450 square feet and of an efficiency unit from 350 square feet to 318 square feet, subject to the following conditions:

1.       The minimum size of the dwelling units shall be 450 square feet.

2.       The minimum size of the efficiency units shall be 318 square feet.

D.      Variance to reduce the front yard setback along Blaisdell Ave.

Recommended Motion: Approve the application to reduce the front yard setback along Blaisdell Ave from the required 15 feet to five feet, subject to the following condition:

1.       The main entry canopy shall be located no closer than 11 feet from the front property line; the main entry ground level patio shall be located no closer than five feet from the front property line and the front facing balconies shall be located no closer than 10 feet from the front property line.

E.       Variance to reduce the front yard setback along W 22nd St.

Recommended Motion: Approve the application to reduce the front yard setback along West 22nd St from the established 22 feet to eight feet, subject to the following condition:

1.       The building shall be located no closer than 13 feet from the front property line; the ground level patios shall be located no closer than 10 feet from the front property line and the front facing balconies shall be located no closer than eight feet from the front property line.

F.       Variance to reduce the south interior side yard setback.

Recommended Motion: Approve the application to reduce the south interior side yard setback from the required five feet to zero feet for the trash receptacle, a transformer and a drive aisle.

G.     Variance to reduce the rear yard setback along the alley.

Recommended Motion: Approve the application for to reduce the rear yard setback along the alley from the required 13 feet to zero feet, subject to the following condition:

1.       The building shall be located no closer than five feet from the rear property line and the balconies shall be located no closer than four feet from the rear property line.

H.      Site plan review.

Recommended Motion: Approve the application for a 74-unit residential building, subject to the following conditions:

1.       All site improvements shall be completed by August 14, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       Windows on the second floor of the building facing the south property line looking into the parking level shall be spaced from one another so there aren’t any blank walls over 25 feet in length.

8.       80 Broadway, 80 Broadway St NE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Curt Gunsbury.

A.      Rezoning.

Recommended Motion: Approve the application to rezone the property from the C2 Neighborhood Corridor Commercial District to the C3A Community Activity Center District.

B.      Conditional use permit.

Recommended Motion: Approve the application for a conditional use permit to increase the maximum building height from 4 stories, 56 feet to 8 stories, 89 feet, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

C.      Variance to decrease the minimum rear yard setback along the east property line.

Recommended Motion: Approve the application to decrease the minimum rear yard setback from 15 feet to 10 feet.

D.      Variance to increase the maximum floor area ratio.

Recommended Motion: Approve the application to increase the maximum floor area ratio from 3.24 to 4.48, subject to the following condition:

1.       The applicant shall incorporate a commercial space of no less than 900 square feet at the ground floor either along the Broadway St NE or Marshall St NE elevation.

E.       Site plan review.

Recommended Motion: Approve the application for a new 98 unit residential building, subject to the following conditions:

1.       All site improvements shall be completed by September 22, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The applicant shall provide a photometric lighting plan that specifies all external lighting fixtures and luminance levels.

4.       The applicant shall install pedestrian scale lighting along the 11th Ave NE façade.

5.       The applicant shall implement a green wall planting trellis along the 11th Ave NE elevation in order to mitigate the blank wall at that location.
