The Planning Commission approved the actions from the August 14, 2017 meeting.

PUBLIC HEARING

1.       2550 Pillsbury Ave, Ward 10

A.      Rezoning.

Action: The City Planning Commission recommended that the City Council approve the application to rezone the property located at 2550 Pillsbury Ave from the R2B/Two-Family District to the R4/Multiple-Family District.

E.       Site Plan Review.

Action: Continued the application for a renovation and addition to an existing building in order to establish a new K-12 school to the September 18, 2017 City Planning Commission meeting.

The City Planning Commission adopted staff findings for the applications by Brian Houwman.

A.      Rezoning.

Action:  The City Planning Commission recommended that the City Council approve the petition to rezone the properties located at 301 and 311 E Lake Street at from the C1 Neighborhood Commercial District to the C2 Neighborhood Corridor Commercial District.

B.      Conditional use permit to allow a reception or meeting hall.

Action: Approved the conditional use permit to allow a reception or meeting hall in the C2 Neighborhood Corridor Commercial District, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       The reception or meeting hall use shall not exceed 2,100 square feet in area for the properties at 301 and 311 E Lake Street, as proposed.

3.       A minimum of 18 off-site parking spaces shall be provided through a licensed valet service for events with 75 or more attendees.

C.      Conditional use permit to allow a shopping center.

Action: Approved the conditional use permit to allow a shopping center in the C2 Neighborhood Corridor Commercial District, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

D.      Variance to reduce the minimum parking requirement.

Action: Approved the variance to reduce the minimum parking requirement from 34 to 16 vehicle spaces, subject to the following conditions:

1.       A minimum of 18 off-site parking spaces shall be provided through a licensed valet service for events with 75 or more attendees.

2.       At least ten (10) bicycle parking spaces shall meet the standards for short-term parking per section 541.180 of the zoning code. The short-term bicycle parking spaces may be located in the right-of-way, if approved by Public Works.

E.       Variance to reduce the minimum drive aisle requirement.

Action: Approved the variance to reduce the minimum drive aisle requirement from 22 feet to 0 feet, subject to the following condition:

1.       The width of the surface parking spaces shall not be less than 9 feet in width, and all on-site parking areas shall be restriped per the final approved plans.

F.       Site plan review.

Action: Approved the 5,000 square foot addition to an existing commercial building, subject to the following conditions:

1.       All site improvements shall be completed by August 28, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       A minimum seven-foot-wide on-site landscaped yard shall be provided between the public sidewalk and parking area along 3rd Ave S.

4.       The required landscaped yard along 3rd Ave S shall include one canopy tree, a three-foot-tall open, decorative fence, and a minimum of two (2) shrubs to meet the requirements of section 5301.70 (b) of the zoning code.

5.       The landscaping plan shall be revised to include a total of no fewer than thirteen (13) shrubs throughout the site.

6.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

7.       At least three (3) bicycle parking spaces shall meet the standards for required long-term bicycle parking, per section 541.180 of the zoning code.

8.       All ground floor windows facing a public street shall allow views into and out of the building between four (4) and seven (7) feet above the adjacent grade.

9.       The applicant shall submit a master sign plan prior to the issuance of building permits.

10.   All signage requires a separate permit from CPED.

1.       The applicant shall provide an on-site landscaped yard at least 5 feet wide with screening at a minimum height of 6 feet and not less than 95% opaque along the north property line extending at least 10 feet east and west of the side-facing principal entrances.

Action: Approved the application for a variance to reduce the corner side yard setback from 16 feet to 8.9 feet, subject to the following condition:

1.       The animal run shall be regularly inspected for purposes of maintenance and cleaning.

E.       Site Plan Review.

Action: Approved the application to allow for a new independent living with services apartment building, subject to the following conditions:

1.       All site improvements shall be completed by August 28, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code and the remainder of the required landscaped area shall be covered with turf grass, native grasses, perennial flowering plants, vines, shrubs and other trees; the Mexican Beach Pebble mulch is not allowed as a landscape material.

4.       To comply with Section 530.110-Building placement and to facilitate pedestrian access, the applicant shall install a gate within the patio fence at the corner of Broadway and 2nd. In addition, to comply with Section 530.130-Pedestrian access, the applicant shall install a decorative surface walkway (e.g. brick pavers) connecting the 2nd Street and Broadway Street sidewalks if approved by Public Works.

5.       To comply with Section 535.70-Screening of mechanical equipment, the applicant shall paint the louvers of the individual mechanical units to match the surrounding exterior building cladding.

6.       To comply with Section 530.120-Building Design, the first floor shall have clear or lightly tinted glass with a visible light transmittance ratio of six-tenths (0.6) or higher and the first floor windows needed to meet the minimum requirement shall allow views into and out of the building at eye level.

7.       To comply with Section 530.120-Building design, the applicant shall install windows on the southern portion of the 2nd Street elevation (west elevation) that continues the same fenestration pattern as the rest of the first floor building elevation.

8.       As a form of alternative compliance for increasing the number of curb cuts, CPED is recommending that the applicant sign the one-way access configuration on the pavement or with signage.

F.       Vacation for a cul de sac.

Action: The City Planning Commission recommended that the City Council approve the application (Vacation file 1690) for a cul de sac left over from a previous vacation (Vacation 1537), subject to the following conditions:

1.       Recording of a new alley easement that maintains alley access for the block.

2.       Retention of easements for Xcel Energy and CenterPoint Energy.
