The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Balance Properties III, LLC.

A.      Vacation.

Recommended Motion: Approve the vacation of the north 120 feet of the alley in Block 7, Excelsior Addition, bounded by the Midtown Greenway on the north, W Lake St, on the south, Garfield Ave S on the west and Harriet Ave on the east, subject to the retention of easements for Xcel Energy and CenturyLink.

2.       504 29th Ave SE, 501 and 518 Malcolm Ave SE, Ward 2

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the application by Wall Development Company LLC.

A.      Registered land survey.

Recommended Motion: Approve the application for a preliminary and final registered land survey, subject to the following conditions:

1.       This action of the Planning Commission shall be recorded with Hennepin County at or prior to such time as the signed RLS is presented for recording with Hennepin County.

3.       Target Field Station Mixed Use Project, 505 6th Ave N, Ward 5

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by United Properties.

A.      Variance of the dynamic changeable copy sign regulations.

Recommended Motion: Approve the application to vary the dynamic changeable copy sign regulations including, subject to the following conditions:

1.       The dynamic changeable copy sign shall be limited to letters or numbers only.

2.       The background of the dynamic changeable copy sign shall be black and the text shall be colored.

3.       Between sunrise and sunset the maximum luminance shall be 5,000 nits and between sunset and sunrise the maximum luminance shall be 500 nits. All signs with a dynamic display having illumination by means other than natural light must be equipped with an automatic dimmer control or other mechanism that automatically controls the sign's brightness to comply with this requirement.

4.       The dynamic changeable copy sign shall not display messages or be illuminated when the use is closed.

B.      Variance of projecting sign height.

Recommended Motion: Approve the variance to increase the maximum height of a projecting sign from the maximum 28 feet to 40 feet.

C.      Variance of projecting sign size.

Recommended Motion: Approve the variance to increase the maximum size of a projecting sign from the maximum 48 square feet to 65 square feet.

D.      Variance to allow signs on a non-primary building wall.

Recommended Motion: Approve the variance to allow signs on a non-primary building wall, subject to the following condition:

1.       There shall be no more than four wall signs and one dynamic changeable copy sign located on the east elevation of the building.

E.       Variance of wall sign height.

Recommended Motion: Approve the variance to increase the maximum height of five wall signs, subject to the following conditions:

1.       No wall sign on the north elevation shall exceed the 28-foot height limitation.

2.       There shall be no more than two signs for the theater located on the north elevation.

F.       Variance of maximum sign allowance.

Recommended Motion: Approve the variance to increase the total amount of signage allowed on a building wall, subject to the following conditions:

1.       There shall be no more than 482 square feet of signage on the north elevation of the building.

2.       There shall be no more than 231 square feet of signage on the east elevation of the building.

G.     Variance to reduce off-street loading.

Recommended Motion: Approve the variance to reduce the off-street loading requirement from two large and one small to one large and one small.

H.      Site Plan Review.

Recommended Motion: Approve the site plan review for a new mixed use building including a hotel, theater and restaurant, subject to the following conditions:

1.       All site improvements shall be completed by October 2, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.       There shall be no fewer than five trees in the boulevard along 6th Ave N.

4.       401 University Ave SE, Ward 3

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Scott Nelson of DJR Architecture.

A.      Conditional Use Permit.

Recommended motion: Approve the application to increase the maximum height in the R5 Multiple-Family District from 4 stories or 56 stories, whichever is less, to 5 stories / 52 feet, 4 inches, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

2.       No fewer than 8 bicycle parking spaces shall be provided between the building and University Ave SE, as proposed.

B.      Variance to decrease the front yard setback.

Recommended motion: Approve the variance to reduce the front yard setback requirement along University Ave SE from 15 feet to 7.5 for the building wall and rooftop deck, to 5 feet for a canopy, to 2.5 feet for balconies on floors 2-4, and to 0 for the ground floor patio, subject to the following condition:

1.       The applicant shall obtain the necessary encroachment permits for all building and site features that are located in the public right-of-way.

C.      Variance to decrease the corner side yard setback.

Recommended motion: Approve the variance to reduce the corner yard setback requirement along 4th Ave SE from 16 feet to 0 feet to allow the west building wall, canopy, deck, and ground floor patio, subject to the following conditions:

1.       The applicant shall obtain the necessary encroachment permits for all building and site features that are located in the public right-of-way.

D.      Variance to decrease the interior side yard setback.

Recommended motion: Approve the application to reduce the interior side yard setback requirement along the east property line from 13 feet to 11.5 feet for the building wall, subject to the following condition:

1.       The applicant shall obtain the necessary encroachment permits for all building and site features that are located in the public right-of-way.

E.       Variance to increase the maximum floor area ratio.

Recommended motion: Approve the variance to increase the maximum allowed floor area ratio from 2.4 to 2.9.

F.       Variance to reduce the minimum vehicle parking requirement.

Recommended motion: Approve the variance to reduce the minimum vehicle parking requirement from 21 to 18.

G.     Variance to increase the percentage of compact parking stalls.

Recommended motion: Approve the variance to increase the percentage of required parking spaces that may be satisfied with compact parking spaces from 25 percent to 81 percent.

H.      Site Plan Review.

Recommended motion: Approve the application for a new, five-story multiple-family dwelling with 43 dwelling units, subject to the following conditions:

1.       All site improvements shall be completed by October 2, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       The plant materials, and installation and maintenance of the plant materials, shall comply with sections 530.200 and 530.210 of the zoning code.

4.       The applicant shall obtain a separate permit for all signage.

5.       All mechanical equipment shall be screened per section 535.70 of the zoning code.

6.       The applicant shall submit a lighting plan showing footcandles at the nearest property line, and shall demonstrate that lighting is provided at all building entrances, and along walkways that maintain a minimum acceptable level of security while not creating glare or excessive lighting of the site.

7.       The landscaping plan shall be updated to include plantings with diverse seasonal interest in the landscaped beds along the east and west elevations of the building. In addition, the applicant shall provide three living walls on the west elevation facing 4th Ave SE, as proposed in the elevation plan.

8.       There shall be a minimum six-inch relief between the metal siding and fiber cement siding on the east and west elevations.

9.       The maximum percentage of fiber cement siding on the east elevation shall not exceed 53 percent of the overall total, and the maximum percentage of fiber cement siding on the west elevation shall not exceed 36 percent, as proposed.

5.       3000 4th St SE, 3024 4th St SE, and 3033 University Ave SE, Ward 2

The Department of Community Planning and Economic Development recommends that the City Planning Commission adopt staff findings for the applications by Oppidan Investment Company.

A.      Rezoning.

Recommended motion: Approve the application to rezone the properties located at 3004 and 3024 4th St SE from the I1 Light Industrial District to the C3A Community Activity Center District and retaining the PO Pedestrian Oriented Overlay and UA University Area Overlay Districts.

B.      Rezoning.

Recommended motion: Approve the application to rezone the property at 3033 University Ave SE from the C2 Neighborhood Corridor District to the C3A Community Activity Center District and retaining the PO Pedestrian Oriented Overlay and UA University Area Overlay Districts.

C.      Conditional Use Permit to increase the height of the building.

Recommended motion: Approve the application to increase the maximum permitted building height from 4 stories/56 feet to 10 stories/122.8 feet, subject to the following condition:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

D.      Conditional Use Permit to allow an assisted living facility.

Recommended motion: Approve the application to allow for an assisted living facility in the C3A District, subject to the following conditions:

1.       The conditional use permit shall be recorded with Hennepin County as required by Minn. Stat. 462.3595, subd. 4 before building permits may be issued or before the use or activity requiring a conditional use permit may commence. Unless extended by the zoning administrator, the conditional use permit shall expire if it is not recorded within two years of approval.

E.       Variance to increase floor area ratio.

Recommended motion: Approve the application to increase the maximum floor area ratio from 2.7 to 4.16.

F.       Variance to increase building setback in PO District

Recommended motion: Approve the application to increase the maximum setback in a Pedestrian Oriented Overlay District from 8 feet to 12 feet for the building along 30th Ave SE.

G.     Variance to allow parking to front street in PO District

Recommended motion: Approve the application to allow parking frontage along a street to exceed 40 feet in width in a Pedestrian Oriented Overlay District, subject to the following condition:

1.       The applicant shall implement the landscape plan as shown with the proposed plantings and the larger than typical landscape yard between the parking area and the public street.

H.      Site Plan Review.

Recommended motion: Approve the application for a new mixed-use building including 283 dwelling units (325 beds) and 8,754 square feet of commercial space, subject to the following conditions:

1.       All site improvements shall be completed by November 3, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

2.       CPED staff shall review and approve the final site, elevation, landscaping, and lighting plans before building permits may be issued.

3.       To comply with Section 530.260-Crime Prevention Through Environmental Design requirements, the building shall contain pedestrian scaled exterior lighting on the University and Malcolm Ave elevations. Said lighting shall be mounted on the first story, evenly spaced and directed in a manner that illuminates the ground plane.

4.       All mechanical equipment, including the ground floor transformers, shall be screened in compliance with Chapter 535. To comply with Section 535.70-Screening of mechanical equipment, the applicant shall paint the louvers of the individual mechanical units to match the surrounding exterior building cladding.

5.       To comply with Section 530.120-Building design, CPED is recommending that windows not be more than 25 linear feet apart for all floors for West A Elevation. In addition, the brick arch detail on West B Elevation shall be continued in a similar fashion for the duration of this wall to break up the blank wall near University Ave. Finally, to comply with Section 551.120-Building Façade, the bottom of any window used to satisfy the ground floor window requirement for nonresidential uses may not be more than two (2) feet above the adjacent grade.

6.       To comply with Table 543-2-Specific Standards for Signs in Commercial Districts, a maximum of 66 square feet of signage is allowed on Elevation-West A.
