Staff report
Variance: James Schloemer of Kaas Wilson Architects, on behalf of Northern X-Ray Company has applied for a variance of the allowed location of off-site parking, as specified in Table 541-5 Location of Off-Site Parking. The property located at 2100 4th Ave S (zoned C2 Neighborhood Corridor Commercial District) would be developed as a parking lot accessory to the existing office building located at 2102 4th Ave S (zoned C4 General Commercial District).
Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt the staff findings and approve of the variance of the allowed location of off-site parking, as specified in Table 541-5 Location of Off-Site Parking. The property located at 2100 4th Avenue South (zoned C2 Neighborhood Corridor Commercial District) would be developed as a parking lot accessory to the existing office building located at 2102 4th Ave S (zoned C4 General Commercial District), subject to the following conditions of approval:
  1. Approval of the final site and landscaping plans by the Department of Community Planning and Economic Development.
  2. All site improvements shall be completed by October 10, 2015, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

A. Variance: Eric Galatz of Leonard, Street and Deinard, on behalf of United Properties Investment, LLC, has applied for a variance to the NM Nicollet Mall Overlay standards requiring street level retail or restaurant uses from 60% to 20% of the gross floor area of the first floor for the property located at 501 Nicollet Mall in the B4-2 Downtown Business District, NM Nicollet Mall Overlay District and DP Downtown Parking Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment adopt staff findings and approve the variance to the NM Nicollet Mall Overlay standards requiring street level retail or restaurant uses from 60% to 20% of the gross floor area of the first floor for the property located at 501 Nicollet Mall in the B4-2 Downtown Business District, NM Nicollet Mall Overlay District and DP Downtown Parking Overlay District, subject to the following conditions of approval:

Variance: Eric Galatz of Leonard, Street and Deinard, on behalf of United Properties Investment, LLC, has applied for a variance to the NM Nicollet Mall Overlay standards requiring street level retail or restaurant uses to occupy at least 60% of the gross floor area of the first floor and must extend along at least 60% of the first floor façade fronting on Nicollet Mall for the property located at 501 Nicollet Mall in the B4-2 Downtown Business District, NM Nicollet Mall Overlay District and DP Downtown Parking Overlay District.
Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment accept the withdrawal of the application for a variance to the NM Nicollet Mall Overlay standards requiring street level retail or restaurant uses to occupy at least 60% of the first floor façade fronting on Nicollet Mall for the property located at 501 Nicollet Mall in the B4-2 Downtown Business District, NM Nicollet Mall Overlay District and DP Downtown Parking Overlay District.
3.   1023 Mount Curve Ave (BZZ #6252, Ward 7) (Shanna Sether)
Staff report
Variance: Dan Nepp of Tea2 Architects, on behalf of Jeffrey Brown and K.C. Sill, has applied for a variance to increase the maximum height of a detached garage from 12 feet to 16 feet accessory to a single-family dwelling located at 1023 Mount Curve Ave in the R2 Two-Family District.  
Recommended Motion: The Department of Community Planning and Economic Development recommends that the Board of Adjustment accept the withdrawal of the variance to increase the maximum height of a detached garage from 12 feet to 16 feet accessory to a single-family dwelling located at 1023 Mount Curve Ave in the R2 Two-Family District.
