APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. Staff report by Mei-Ling Smith, PLAN 3702

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by James Brown of Brownsmith Restoration.

A.      Variance of the enclosed building requirement.

Recommended motion: Deny the variance to allow outdoor dining closer than 20 feet from the adjacent residential use.

B.      Variance to allow a ground floor patio exceeding 50 square feet and planters exceeding 3 feet in height in the required front yard.

Recommended motion: Deny the variance application to allow a ground floor patio exceeding 50 square feet and planters exceeding 3 feet in height in the required front yard along Como Ave SE.

C.      Variance to reduce the minimum parking requirement.

Recommended motion: Deny the variance application to reduce the minimum parking requirement from 8 to 4 vehicle parking spaces.

2.       3037 Aldrich Ave S, Ward 10

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Ultimate Restoration Inc.

A.      Variance.

Recommended motion: Approve the application for a variance to reduce the required front yard from 15 feet to 9.9 feet for the habitable portion of the structure and from 10 feet to 3 feet for an open porch, subject to the following conditions:

1.       Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by May 18, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.

3.       5333 Portland Ave, Ward 11

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Chad DeBaker.

A.      Variance.

Recommended motion: Approve the application to develop within 40 feet of a steep slope subject to the following conditions:

1.       Approval of the final site, elevation and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by May 18, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

4.       4705 31st Ave S, Ward 12

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Carmen Parotta.

A.      Variance to reduce the north interior side yard requirement.

Recommended motion: Approve the variance to reduce the north interior side yard requirement from 5 feet to 2.8 feet, subject to the following condition:

1.       CPED staff shall review and approve the final site plans, floor plans, and elevations before building permits may be issued.

B.      Variance to reduce the front yard requirement.

Recommended motion: Approve the variance to reduce the front yard requirement along 31st Ave S from between 33.6 and 34.5 feet to 31.9 feet, subject to the following condition:

1.       CPED staff shall review and approve the final site plans, floor plans, and elevations before building permits may be issued.

5.       2508 W 40th St, Ward 13

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Laura Christensen and Zan Ceeley.

A.      Variance.

Recommended motion: Approve the variance to reduce the east interior side yard requirement from 6 feet to 4.5 feet for the enclosed porch and to 2.5 for the eave, subject to the following conditions:

1.       CPED staff shall review and approve the final site plans, floor plans, and elevations before building permits may be issued.

2.       The rail style shall match the architectural features of the existing railings on the exterior of the home.

3.       The finish of the porch shall match the finish of the dwelling or the trim on the dwelling.

6.       807 Broadway St NE, Ward 1

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Jason Meyer of Quality Sign Solutions.

A.      Variance.

Recommended motion: Deny the variance to increase the maximum height of an attached wall sign in the I1 Light Industrial District from 28 feet to 46 feet.

7.       1029 Marshall St NE, Ward 3

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Scott Fossland.

A.      Variance.

Recommended motion: Approve the variance to allow outdoor dining closer than 20 feet from the adjacent residential zoning district, subject to the following conditions:

1.       CPED staff shall review and approve the final site plan before building permits may be issued.

2.       The screening on all sides of the existing and proposed outdoor dining area shall be consistent in design and materials, and vines shall be planted to provide additional screening.
