APPROVAL OF AGENDA

The commission may take action on items as part of a consent agenda at the beginning of the meeting. In these instances, the commission president will open the public hearing at the beginning of the meeting and will ask whether anyone would like to provide testimony or express concerns about items recommended for the consent agenda. The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Paul Kustermann.

A.      Variance to reduce the minimum lot area requirement.

Recommended motion: Approve the variance to reduce the minimum lot area requirement from 5,000 square feet to 3,962 square feet, subject to the following condition:

1.       The applicant shall obtain and maintain all necessary licenses and registrations as to establish a community residential facility.

B.      Variance to reduce the minimum lot width requirement.

Recommended motion: Approve the variance to reduce the minimum lot width requirement from 40 feet to 35 feet.

2.       501 Cedar Lake Rd, Ward 7

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Cheri Saari.

A.      Variance to the front yard setback requirement.

Recommended motion: Approve the application for a variance to decrease the front yard setback along Cedar Lake Road S from 39.1 feet to 20 feet subject to the following conditions:

1.       Approval of the final site, elevation, and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by July 27, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

B.      Variance to the interior side yard setback requirement.

Recommended motion: Approve the application for a variance to decrease the interior side yard setback 8 feet to 5 feet, subject to the following conditions:

1.       Approval of the final site, elevation, and floor plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by July 27, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

3.       717 Kenwood Pkwy, Ward 7

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Robert Reul & Janet Jones.

A.      Variance to build a rear addition and an attached garage on a steep slope in the Shoreland Overlay District.

Recommended motion: Approve the application for a variance to allow development on a steep slope in the Shoreland Overlay District, subject to the following conditions:

1.       CPED staff shall review and approve the final site plans, floor plans, and elevations before building permits are issued.

2.       All site improvements shall be completed by July 27, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

B.      Variance to allow an attached garage and a deck exceeding 50 square feet in the required front yard.

Recommended motion: Approve the application to allow development in the required front yard, subject to the following conditions:

1.        CPED staff shall review and approve the final site plans, floor plans, and elevations before building permits are issued.

2.       All site improvements shall be completed by July 27, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

C.      Variance to allow an attached garage facing the front lot line.

Recommended motion: Approve the application to allow a garage facing front yard exceeding 60% maximum width, subject to the following conditions:

1.       CPED staff shall review and approve the final site plans, floor plans, and elevations before building permits are issued.

2.       All site improvements shall be completed by July 27, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

4.       1012 LaSalle Ave, Ward 7

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by The University of St. Thomas.

A.      Variance to the maximum number of freestanding signs on a zoning lot.

Recommended motion: The application for a variance to exceed the maximum of one freestanding sign on a zoning lot has been withdrawn by the applicant.

5.       2104 Irving Ave S, Ward 7

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by James Regan.

A.      Variance to allow development on a steep slope in the Shoreland Overlay district for the construction of two retaining walls.

Recommended motion: Approve the application for the construction of two four-foot retaining walls on a steep slope in the Shoreland Overlay district, subject to the following conditions:

1.       Approval of final site and construction plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by July 27, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for non-compliance.

3.       Erosion control fencing shall remain in place throughout and after construction until vegetation capable of preventing erosion has been established on the site.

6.       725 Vineland Place and 1750 Hennepin Ave, Ward 7

The Department of Community Planning and Economic Development recommends that the Zoning Board of Adjustment adopt staff findings for the applications by Melanie Hoang of Archetype Sign.

A.      Variance to increase the maximum number of freestanding signs on a zoning lot in the OR2 High Density Office Residence District.

Recommended motion: Approve the application for a variance to increase the maximum number of freestanding signs on a zoning lot to allow three freestanding signs on the Vineland Place frontage, subject to the following conditions:

1.       Approval of the final site and sign plans by the Department of Community Planning and Economic Development.

2.       All site improvements shall be completed by July 27th, 2019, unless extended by the Zoning Administrator, or the permit may be revoked for noncompliance.

B.      Variance to allow a dynamic sign in the OR2 High Density Office Residence District.

Recommended motion: Deny the application for a variance to allow a dynamic sign in the OR2 High Density Office Residence District.

C.      Variance to allow a dynamic sign on less than 660 feet of Commercial, Industrial, or Downtown street frontage.

Recommended motion: Deny the application for a variance to allow a dynamic sign on less than 660 feet of Commercial Downtown or Industrial street frontage.

 

D.      Variance to allow a dynamic sign less than 100 feet from a Residence or Office Residence district property line.

Recommended motion: Deny the application for a variance to allow a dynamic sign less than 100 feet from a Residence or Office Residence district property line.
